Artikelsamenvatting bij Persbericht van het HvJ nr. 118/19 inzake Fiat (zaak C-755/15 Luxembourg v Commission en T-759/15 Fiat Chrysler Finance Europe v Commission)
In 2015 bepaalde de Commissie dat een Luxemburgse tax ruling met Fiat leidde tot illegale staatssteun. Zowel Luxemburg als Fiat kwamen in rechte op tegen dit besluit. Het Hof van Justitie heeft bij uitspraak van 24 september 2019 echter bepaald dat het besluit van de Commissie geldig is. Het verwerpt de vijf bezwaren van Fiat en Luxemburg:
- Het besluit van de Commissie is geen vermomde poging tot harmonisering van belastingen.
- De tax ruling zorgde er wel degelijk voor dat Fiat bevoordeeld werd, in vergelijking met een soortgelijke onderneming in een normale markt. Er was hier sprake van interne transacties binnen het Fiat-concern, de Commissie heeft deze transacties beoordeeld aan de hand van het at arms length-beginsel, dat inhoudt dat dit soort transacties wordt vergeleken met transacties die op de markt tussen onafhankelijke partijen tot stand zouden komen. Ook heeft de Commissie de correcte methode gebruikt om het voordeel van Fiat te berekenen.
- Het voordeel was selectief: het gold alleen voor Fiat. Luxemburg en Fiat bestreden deze conclusie van de Commissie.
- De tax ruling zorgde wel degelijk voor een verstoring van de eerlijke concurrentie en handel tussen lidstaten.
- De Commissie heeft niet het rechtszekerheidsprincipe en het recht op een eerlijke verdediging geschonden.

- Starting Pages: for some fields of study and some university curricula editors have created (start) magazines where customised selections of summaries are put together to smoothen navigation. When you have found a magazine of your likings, add that page to your favorites so you can easily go to that starting point directly from your profile during future visits. Below you will find some start magazines per field of study
- Use the menu above every page to go to one of the main starting pages
- Tags & Taxonomy: gives you insight in the amount of summaries that are tagged by authors on specific subjects. This type of navigation can help find summaries that you could have missed when just using the search tools. Tags are organised per field of study and per study institution. Note: not all content is tagged thoroughly, so when this approach doesn't give the results you were looking for, please check the search tool as back up
