Hoe werkt vergelding en vergoeding? - Chapter 1

  • Accusatoir strafproces: Een strafprocesvorm waarin beide partijen elkaar met gelijke middelen in het strafproces de rechtsstrijd met elkaar aangingen.

  • Faidus: Dit was het bedrag die betaald moest worden om de vrede tussen de families te herstellen.

  • Fredus: Dit was het bedrag die betaald moest worden om de algehele stamvrede te herstellen.

  • Inquisitoir strafproces: Een strafprocesvorm waarin de aanklager de dader aanklaagt die dan terecht moet staan.

  • Leges barbarorum: De wetten der barbaren.

  • Private aangelegenheid: In de tijd van de Germanen was dit geen publieke aangelegenheid, omdat het een aangelegenheid betrof tussen de familie van het slachtoffer en de familie van de dader.

  • Stamkoning: Leider van de familie.

  • Talio: De geweldpleger werd gestraft naar evenredigheid naar wat hij het slachtoffer had aangedaan.

Wat wordt verstaan onder schuld en straf? - Chapter 2

  • Animus: Het motief, het oogmerk of het doel waarmee iemand een strafbaar feit pleegt.

  • Canonieke recht: In dit recht was de gedachte dat iemand niet behoorde bestraft te worden omdat hij een daad had gepleegd die onacceptabel was, maar omdat deze daad aan hem kon worden toegerekend en verweten.

  • Daadstrafrecht: De feiten bepaalde welk delict was gepleegd en welke straf er moest worden opgelegd.

  • Gevolgsaansprakelijkheid: De aansprakelijkheid voor de dader die terecht stond voor de feitelijke gevolgen die uit zijn daad uitvloeide.

  • Inheems strafrecht: Dit strafrecht was gebaseerd op hetgeen wat kon worden waargenomen.

  • Klassieke Richting: Een stroming in het strafrecht waarin de nadruk werd gelegd op een rationeel strafrecht in overeenstemming met de menselijke rede.

  • Opzettelijke doodslag: Dit kon ten laste worden gelegd aan de dader wanneer het slachtoffer met een wapen om het leven was gebracht.

  • Schuldstrafrecht: De dader moest opzettelijk zijn handeling hebben verricht en de handeling moest hem kunnen worden verweten.

  • Capitularia: Een verordening.

  • Geschreven rechtsregels: Dit waren meestal privileges die gericht waren aan een bepaalde bevolkingsgroep of gemeenschap.

  • Landsvrede: De rechten en belangen van de ingezetenen werden veiliggesteld als een bepaalde situatie daarom vroeg.

  • Poena certa: Een vaste straf.
