Feiten
I.c. gaat het om een situatie die zich voor heeft gedaan op 31 december 2007. Er ontstaat die dag onenigheid tussen een groep personen en omdat de verdachte van plan is om de belagers van zijn vriend weg te jagen, besluit hij zijn mes te pakken. Hierna ontstaat een vechtpartij gedurende welke de verdachte het mes in zijn hand heeft. Op enig moment vraagt de vriend om het mes, waarna de verdachte het mes geeft omdat zijn vriend wordt aangevallen. Daardoor voelt hij zich bedreigd. Op het moment dat de belagers het mes zien, nemen zij afstand. Echter de vriend van de verdachte steekt twee van de belagers met het mes. Een belager wordt in zijn rug gestoken en de andere in zijn been.
De verdachte wordt veroordeeld wegens medeplichtigheid aan poging tot doodslag en medeplichtigheid aan poging tot zware mishandeling.
Hoge Raad
In cassatie staat de vraag centraal naar de bewezenverklaring van het voor medeplichtigheid vereiste opzet, omdat de verdachte niet wist of kon weten dat zijn vriend met het mes zou gaan steken. Volgens hem is het hof uitgegaan van een onjuiste rechtsopvatting vanwege het ontbreken van opzet op de gepleegde misdrijven.
Uit de uitspraak van de Hoge Raad blijkt dat (volledig) opzet op het gronddelict niet vereist is, maar een ‘voldoende verband’ tussen het gronddelict en het misdrijf waarop het opzet van de medeplichtige was gericht is wel vereist. Wanneer een ‘voldoende verband’ aanwezig wordt geacht, lopen het opzet van de medeplichtige en de dader(s) niet ‘totaal’ respectievelijk ‘geheel’ uiteen. Dit ‘voldoende verband’ is volgens de Hoge Raad afhankelijk van de concrete omstandigheden van het geval. Toch kan worden aangenomen dat dit verband bestaat als het misdrijf waarop het (voorwaardelijk) opzet van de medeplichtige was gericht, een onderdeel vormt van het gronddelict, zoals het geval is bij een misdrijf dat is begaan onder strafverzwarende omstandigheden.
