Het leerstuk dat in dit arrest van de Hoge Raad centraal staat is de aansprakelijkheid van een medeplichtige. Het gaat in deze zaak om een verdachte die opzettelijk een mes heeft verschaft, waarmee een ander vervolgens een poging tot doodslag en een poging tot zware mishandeling heeft begaan.
De Hoge Raad oordeelt dat voor opzettelijke medeplichtigheid aan een misdrijf niet is vereist dat het opzet van de medeplichtige gericht was op alle handelingen van het gronddelict. Indien het opzet van de verdachte slechts betrekking heeft op een deel van die handelingen, kan er al sprake zijn van opzettelijke medeplichtigheid aan het gronddelict. Het misdrijf waarop het opzet van de medeplichtige was gericht, moet echter wel voldoende verband houden met het gronddelict. Of er sprake is van voldoende verband, wordt beoordeeld aan de hand van de concrete omstandigheden van het geval. Volgens de Hoge Raad heeft het Hof juist geoordeeld door te stellen dat het misdrijf waarop het opzet van verdachte was gericht, voldoende verband hield met de poging tot doodslag en de poging tot zware mishandeling.
