Eindhovense brandstichting (HR 19 maart 1934, NJ 1934/450)
Casus
H. en G. zouden in Eindhoven op 4 juni 1933 brand stichten in een woning. Het echtpaar, dat het huis bewoonde, was die dag naar Den Haag gegaan. De heren troffen alle voorbereidingen, zodat er `s avonds alleen nog maar aan het touwtje moest worden getrokken dat in verbinding stond met de trekker van een gaspistool die het vuur zou ontsteken. Echter de buren en de nachtwaker roken de benzine en waarschuwden de politie.
Aan de een werd poging tot brandstichting ten laste gelegd (art. 45 lid 1 jo art. 157 Sr) en aan de ander medeplichtigheid aan poging tot brandstichting (art. 48 jis artt. 45 lid 1 en 157 Sr). Beiden voerden echter aan dat er in casu slechts sprake was van voorbereidingshandelingen en niet van uitvoeringshandelingen. Het Hof veroordeelde de hoofdverdachte tot vier jaar gevangenisstraf en zijn medeplichtige tot zes maanden, beiden wegens poging tot brandstichting.
Rechtsregel
De Hoge Raad heeft zich over deze zaak gebogen en afgevraagd of er hier inderdaad sprake was van een poging tot brandstichting. Voor een poging tot een bepaald misdrijf is vereist dat de verdachte is begonnen met de uitvoering van het misdrijf. Doorslaggevend voor `begin van uitvoering' is dat het gaat om een gedraging welke naar ervaringsregels zonder enig nader ingrijpen van de dader tot brandstichting leidt. In casu voldoen de bewezenverklaarde handelingen niet aan het vereiste van de strafbare uitvoeringshandeling!
Een daad dat is verricht welke zonder onverwachte gebeurtenis of zonder ingrijpen van de verdachte of anderen zal leiden tot het misdrijf (i.c. Brandstichting). De Hoge Raad is van mening dat de handelingen die tot dusver waren verricht geen handelingen zijn welke zonder ingrijpen leiden tot brandstichting. Immers is daarvoor vereist dat de verdachte de daad van het trekken aan het over het muurtje hangende touwtje moet verrichten. Er is geen volledige zekerheid dat de man de daad volvoerd zou hebben als er niets tussen was gekomen. De Hoge Raad komt daarom tot de beslissing om over te gaan tot ontslag van rechtsvervolging. Er is geen sprake van een poging tot brandstichting.
De Hoge Raad gaat in dit arrest uit van de (extreme) objectieve (pogings)leer. Onder de gegeven omstandigheden vielen alle handelingen tot het trekken aan het touwtje onder voorbereidingshandelingen.
