Samenvatting week 2 Inleiding Burgerlijk Recht

Week II 

Lastgevingsovereenkomst (art. 7:414) is de obligatoire overeenkomst van opdracht waarbij de ene partij (lasthebber) verricht voor de rekening van de lastgever --> verplicht rechtshandeling te verrichten (A en T komen overeen dat T in naam van A het huis van B zal kopen). 
Vertegenwoordiging is het verrichten van rechtshandeling in naam van een ander die daartoe bevoegd is. Dus lastgeving verplicht en volmacht bevoegd. Volmacht is de door een rechtshandeling verleende bevoegdheid een ander te vertegenwoordigen (3:60). De gevolmachtigde mag handelingsonbekwaam zijn, maar volmachtgever niet. Degene is dan bevoegd maar niet verplicht. De commissionair is de tussenpersoon. 

  • Lastgeving zonder volmacht en vertegenwoordiging (A komt met T overeen dat T een jas bij B koopt voor A) 

  • Volmacht en vertegenwoordiging zonder lastgeving (A aan T bevoegdheid indien hij een jas ziet van 500 hij die in naam van A koopt) 

  • Vertegenwoordiging zonder volmacht (ouders van A kopen een jas voor A) 

Volmacht (art. 3:60) 

  • Bevoegdheid een ander te vertegenwoordigen 

  • Gevolmachtigde kan handelingsonbekwaam zijn (art. 3:63 lid 1) 

  • Niet privatief: volmachtgever mag ook zelf goed kopen 

  • Vereisten (3:66 lid 1) 
    - Binnen de grenzen van zijn bevoegdheid 
    - Geen overeenkomst met tussenpersoon, hij valt ertussenuit 

Hoe nog wel een overeenkomst tot stand kan komen is door: 

  • Bekrachtiging (art. 3:69) 

  • Beroepen op gerechtvaardigd vertrouwen (art. 3:61 lid 2) 

  • Schadevergoeding (art. 3:70) --> kosten betalen van buiten bevoegdheid, tenzij wederpartij wist dat hij buiten bevoegdheid handelde 

Indien gevolmachtigde in naam van een ander een rechtshandeling verricht zonder daartoe bevoegd te zijn, komt er geen rechtshandeling tot stand. Dit zorgt ervoor dat de pseudo-principaal niet gebonden is aan de pseudo-gevolmachtigde ook niet gebonden, want niet in zijn naam verricht. 

Bij bekrachtiging krijgt de rechtshandeling hetzelfde gevolg indien zij met volmacht waren verricht: de bekrachtiging heeft terugwerkende kracht.

There are several ways to navigate the large amount of summaries, study notes en practice exams on JoHo WorldSupporter.

  1. Use the menu above every page to go to one of the main starting pages
    • Starting pages: for some fields of study and some university curricula editors have created (start) magazines where customised selections of summaries are put together to smoothen navigation. When you have found a magazine of your likings, add that page to your favorites so you can easily go to that starting point directly from your profile during future visits. Below you will find some start magazines per field of study
  2. Use the topics and taxonomy terms
    • The topics and taxonomy of the study and working fields gives you insight in the amount of summaries that are tagged by authors on specific subjects. This type of navigation can help find summaries that you could have missed when just using the search tools. Tags are organised per field of study and per study institution. Note: not all content is tagged thoroughly, so when this approach doesn't give the results you were looking for, please check the search tool as back up
  3. Check or follow your (study) organizations:
    • by checking or using your study organizations you are likely to discover all relevant study materials.
    • this option is only available trough partner organizations
  4. Check or follow authors or other WorldSupporters
    • by following individual users, authors  you are likely to discover more relevant study materials.
  5. Use the Search tools
    • 'Quick & Easy'- not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject.
