Vraag 1

Eveline heeft ingestemd met haar fulltime aanstelling. Eveline is, hoewel zij nu veel overuren maakt, blij met haar uitdagende baan. Wanneer Eveline voor de derde week op rij meer dan 12 uur per dag werkt wordt het haar te veel. De stressvolle werkzaamheden hebben ervoor gezorgd dat Eveline overspannen is geraakt. Op 21 april 2015 meldt Eveline zich ziek. Wanneer Eveline na drie dagen nog niet beter is, belt haar baas geïrriteerd op. Hij is niet blij met de ziekmelding van Eveline, het bedrijf is nog te klein om een werkkracht voor langere tijd te kunnen missen. De gemoederen tussen Eveline en haar werkgever lopen al snel hoog op. De baas van Eveline neemt haar gezondheidsklachten niet serieus en eist van haar dat zij in ieder geval naar de wekelijkse vergaderingen komt. Tevens wil hij dat zij een uurtje per week met de bedrijfsarts praat om haar zo snel mogelijk te laten re-integreren. Markt waarschuwt Eveline dat haar loonbetaling stopgezet wordt wanneer zij niet aan deze eisen voldoet. Eveline kan het allemaal niet opbrengen; ze is totaal uitgeblust en verschijnt nergens. Hierop besluit Markt om per 1 mei 2015 daadwerkelijk geen loon meer uit te betalen, omdat Eveline niet voldoet aan haar re-integratieverplichtingen.

Nu Eveline niet op de wekelijkse vergaderingen verschijnt en weigert nog met haar, naar eigen zeggen, ‘’botte’’ werkgever te praten heeft zij geen idee dat er besloten is om haar contract niet te verlengen. Eveline schrikt wanneer zij op 15 juni 2015 een e-mail krijgt van haar werkgever met de mededeling dat haar contract niet wordt verlengd. Eveline beantwoordt de mail direct en betoogt dat haar contract helemaal niet kan aflopen, omdat zij nog steeds ziek is. Daarnaast, zo bepleit Eveline, had Markt haar eerder op de hoogte moeten stellen van het feit dat haar contract niet verlengd zou gaan worden.

Gesteld dat het dienstverband van Eveline rechtsgeldig is geëindigd, op welke regeling moet zij zich beroepen om in haar inkomen te voorzien, nu Eveline nog steeds ziek is?

Antwoordindicatie

Vraag 1

Vanaf het moment dat het dienstverband eindigt (30 juni 2015), heeft zij geen recht meer op loon op grond van haar dienstbetrekking met Markt. Eveline kan mogelijk aanspraak maken op een Ziektewetuitkering op grond van art 19 ZW, omdat ze ongeschikt is voor haar eigen arbeid. Nu loon is weggevallen, staat de ZW open op grond van art. 29 ZW. Tevens moet Eveline werknemer zijn in de zin van deze wet (art. 3 – 8b ZW).

When you have found a magazine of your likings, add that page to your favorites so you can easily go to that starting point directly from your profile during future visits. Below you will find some start magazines per field of study
  2. Use the topics and taxonomy terms
    • The topics and taxonomy of the study and working fields gives you insight in the amount of summaries that are tagged by authors on specific subjects. This type of navigation can help find summaries that you could have missed when just using the search tools. Tags are organised per field of study and per study institution. Note: not all content is tagged thoroughly, so when this approach doesn't give the results you were looking for, please check the search tool as back up
  3. Check or follow your (study) organizations:
    • by checking or using your study organizations you are likely to discover all relevant study materials.
    • this option is only available trough partner organizations
  4. Check or follow authors or other WorldSupporters
    • by following individual users, authors  you are likely to discover more relevant study materials.
  5. Use the Search tools
    • 'Quick & Easy'- not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject.
