Welke onderwerpen worden behandeld in het hoorcollege?
Functionele benadering rechtspraak: Je moet als rechter vaststellen wat rechten is. Je moet een bindende beslissing nemen en deze moet tenuitvoer worden gelegd. Binding aan het recht (legaliteit). Full jurisdiction (bevoegd tot alle aspecten). De rechter moet onafhankelijk en onpartijdig zijn.
Rechter in Nederland: De rechter is onderdeel van het openbaar lichaam van de Staat. Rechter treedt op als onafhankelijke en onpartijdige derde die in een concreet geval vaststelt wat rechtens is. Voor partijen worden de gevolgen verbonden die voortvloeien uit het recht.
Onafhankelijkheid: De rechter moet onafhankelijk zijn van andere staatsmachten en andere rechters. In het boek wordt onderscheid gemaakt tussen persoonlijke, zakelijke en institutionele onafhankelijkheid.
Onpartijdigheid: Er wordt onderscheid gemaakt tussen subjectieve en objectieve onpartijdigheid. Subjectieve onpartijdigheid houdt in dat de persoon van de rechter zelf het probleem is. Objectieve onpartijdigheid houdt in dat omstandigheden buiten de personen van de rechter twijfel zaait over de neutraliteit.
Drie opvattingen over de taak van de rechter: 1) Rechter zoek in een concreet geval naar een zo rechtvaardig mogelijke oplossing. 2) Rechter is strikt gebonden aan de wet. De rechter heeft zelf geen functie in het vormen van recht. 3) De rechter heeft een bijzondere positie ten aanzien van grondrechten en de bescherming van minderheden. De democratie is niet goed geschikt voor het respecteren van minderheden. Het is aan de rechter om deze minderheden extra bescherming te bieden op basis van het recht.
