Leebeek/Vrumona - Arrest
HR 24 december 1993, NJ 1994, 214 (r.o. 3.6) (Leebeek/Vrumona)
Casus
Dhr. Leebeek heeft op 10 Sept. 1988 getracht een flesje Pepsi te openen in een sportkantine. De hals van het flesje brak echter af, ten gevolge waarvan Leebeek snijwonden aan zijn linkerhand opliep. Leebeek wil schadevergoeding vorderen van Vrumona, degene die de flesjes Pepsi op de Nederlandse markt brengt. Hij beroept zich op wanprestatie, danwel onrechtmatige daad van Vrumona, aangezien de verwonding volgens hem het directe gevolg is van gebreken aan de fles pepsi.
Vrumona verweert zich door te ontkennen dat de schade het gevolg is van de fles en dat Leebeek dient te bewijzen dat: a) het breken van de fles is te wijten aan een gebrek aan de fles, b) dit gebrek reeds bestond toen de fles werd geleverd, en, c) het product normaal gebruikt is.
Rechtsvraag
Gaat het hoofdbeginsel "hij die stelt, dient te bewijzen" hier ook onverkort op, m.a.w. moet Leebeek inderdaad al hetgeen door Vrumona onder a), b) en c) gesteld, bewijzen?
Rechtbank
Leebeek dient te bewijzen dat de fles Pepsi tijdens normaal gebruik is afgebroken, te gevolge waarvan hij de verwonding opliep. De vordering wordt afgewezen, echter op grond van het feit dat Leebeek er niet in is geslaagd te bewijzen dat het Pepsi betrof.
Hof
Leebeek moet bewijzen dat de fles gebrekkig was, hij is in dit bewijs echter niet geslaagd, de vordering wordt afgewezen.
Hoge Raad
Hof’s oordeel is onvoldoende gemotiveerd: Het hof is voorbijgegaan aan de vraag of Leebeek óók erin geslaagd is te bewijzen dat hij de fles op normale wijze opende. Dit had het Hof wel moeten doen, aangezien als Leebeek geslaagd moet worden geacht in het bewijs dat hij de fles op normale manier trachtte te openen, hierin besloten ligt (m.a.w. vast staat) dat de fles gebrekkig was, behoudens de aanwezigheid van bijzondere omstandigheden.
Leebeek hoeft dus alleen te bewijzen dat hij de fles normaal opende, het rechterlijk vermoeden wijst vervolgens uit dat de fles inderdaad gebrekkig had moeten zijn in het geval van normale opening. Hieruit volgt vervolgens dat op Vrumona de stel- en bewijsplicht ligt dat de fles níet gebrekkig was.
