Welke onderwerpen worden behandeld in het hoorcollege?
Art. 6 EVRM: Focus op lid 1. Eerlijke en openbare behandeling binnen een redelijke termijn door een onafhankelijke en onpartijdige rechter. Reikwijdte: burgerlijke rechten en verplichtingen of strafrechtelijke vervolging.
Burgerlijke rechten en verplichtingen: Zie het arrest Ferrazzini t. Italië. Het moet in principe gaan om een geschil waarin geld of iets wat makkelijk op geld waardeerbaar is in het geding is.
Strafrechtelijke vervolging: Zie het arrest Öztürk/Duitsland. Stappenplan: stap 1) Wordt het in eigen land als strafrechtelijk aangemerkt? Stap 2) Is het strafrechtelijk van aard? Stap 3)Kijken of de aard en zwaarte van de sanctie als een straf aangemerkt moet worden.
Art. 13 EVRM: Als een beroep op art. 6 EVRM niet mogelijk is vanwege de reikwijdte. Reikwijdte: enkel over mensenrechten. Vervolgens heb je niet per se recht op een behandeling door een rechter. Je hebt recht op een onafhankelijke en onpartijdige instantie.
Art. 47 Handvest EU: Breder van aard en combineert de rechten uit art. 6 en 13 EVRM. Je hebt op grond van dit aritkel altijd recht op behandeling door een rechter, maar het Unierecht moet dan wel een rol spelen in de zaak.
