Application of the Convention on the prevention and punishment of the crime of genocide (Bosnia and Herzegovina vs. Serbia and Montenegro) (ICJ 26-02-2007, EIR 580 (566, 515))
Casus
In Srbrenica was genocide gepleegd. De rechtsvraag is of dit aan Serbia en Montenegro toegerekend kan worden. Dit is de eerste zaak van het ICJ waarin een staat (Bosnië-Herzegovina) een andere staat (Servië en Montenegro) beschuldigd van genocide.
ICJ
De eerste vraag die het ICJ moest beantwoorden, was of zij bevoegd was om in deze zaak uitspraak te doen; Servië betwistte dit. Het Hof is bevoegd op basis van de toepasselijkheid van het Genocideverdrag en enkel op basis daarvan mag het Hof rechtspreken. Dit betekent dat het Hof niet bevoegd is om algemeen volkenrecht toe te passen of uitspraken mag doen over andere schendingen.
Het internationaal recht spreekt van genocide, indien:
Er een vooropgezet plan bestond om een bepaalde groep geheel/gedeeltelijk uit te roeien.
Deze groep dient te kunnen worden onderscheiden op basis van bepaalde kenmerken.
Deze vereisten zijn zwaar; in casu werd door het Hof besloten dat er onvoldoende bewijs was geleverd om aan te tonen dat er een vooropgezet plan bestond om de bevolking uit te roeien; enkel in het geval van Srbrenica werd genocide aangenomen. De vraag waar het Hof zich vervolgens over moest buigen, was of deze genocide viel onder de staatsaansprakelijkheid van Servië en Montenegro. Het Hof achtte de troepen die verantwoordelijk waren voor de genocide geen staatsorganen noch erkende het Hof dat de staat effectieve controle over deze groepen had. Het ICJ achtte daarom niet bewezen dat Servië en Montenegro aansprakelijk gesteld kon worden (direct/medeplichtige) voor het plegen van genocide in Bosnië-Herzegovina.
Het Hof achtte Servië en Montenegro wel verantwoordelijk voor het niet voorkomen van de genocide en voor het niet straffen of meewerken aan de bestraffing van de daders. Op de staat rust namelijk een verplichting tot het voorkomen van genocide, met alle mogelijke middelen. De Servische autoriteiten hadden in casu op de hoogte behoren te zijn van de situatie in Srbrenica en maatregelen dienen te nemen. Het Hof erkende hiermee dat onrecht was gedaan en kwam Bosnië-Herzegovina in dit opzicht tegemoet.
