The North Sea Continental shelf cases, (Federal Republic of Germany v. Denmark and Federal Republic of Germany v. Netherands) (ICJ 20-02-1969, EIR 470 (457, 413))
Casus
Ten aanzien van de verdeling van het continentaal plateau van de Noordzee, waren er tussen Duitsland en Nederland en Duitsland en Denemarken afspraken gemaakt. Hoe de verdelingslijnen precies getrokken moesten worden, wilden de partijen voorleggen aan het ICJ.
Rechtsvraag
Welke principes en regels van internationaal recht zijn van toepassing bij de afbakening van de gebieden van de partijen Op het Noordzee Continentaal plateau?
ICJ
Het Hof voegde de twee zaken bij elkaar. Nederland en Denemarken beriepen zich op art. 6-2 csc: er zouden in dit geval speciale omstandigheden zijn. Duitsland beriep zich op een verdeling volgens de doctrine van eerlijke en rechtvaardige verdeling.
Het Hof verwierp zowel het standpunt van Nederland en Denemarken als dat van Duitsland. Het Hof overwoog of er bij art. 6-2 csc sprake is van de vorming van gewoonterecht. Voor het bestaan van gewoonterecht kunnen 5 criteria gelden:
- Het moet gaan om een regel met een fundamenteel normerend karakter die beschouwd kan worden als de basis voor een algemene rechtsregel.
Art. 6-2 voldoet hier niet aan: het is een subsidiaire regel (de eerste regel is: begrenzing middels overeenkomst) en er kan een voorbehoud bij dit artikel worden gemaakt.
- Er hoeft niet een geruime tijd verstreken te zijn t.a.v. het gebruik van de regel, als die maar wijdverbreid en representatief wordt toegepast.
In dit geval is de deelname en ratificatie van de csc onvoldoende om aan dit criterium te voldoen.
- Er moet een redelijke termijn verlopen zijn ten aanzien van de mogelijkheid het verdrag te ratificeren.
Daarvan is hier geen sprake.
- De statenpraktijk dient extensief en nagenoeg uniform te zijn, met name als het gaat om staten wier belangen er sterk bij zijn betrokken.
Dit is hier niet het geval.
- De staten moeten niet alleen handelen volgens een gevestigde praktijk, maar zij moeten er tevens van overtuigd zijn dat het een verplichting is dat ze juist op die wijze handelen (opinio iuris-vereiste)
Ook daarvan kan hier geen sprake zijn.
Daarom besluit het Hof:
Dat er in dit geval geen bindende verdelingsregel is aan te wijzen.
Dat de principes en regels van intern recht hier van toepassing dienen te zijn; er moet een overeenkomst gesloten worden tussen de partijen ten aanzien van de afbakening, die gebaseerd is op rechtvaardige principes en die alle relevante omstandigheden in acht neemt, zodat elk land een rechtvaardig deel krijgt.
