Verzoekster heeft een totale schuld van € 7.486,22 aan vijf schuldeisers. De vordering van Orange op verzoekster bedraagt € 2.644,40. Verzoekster ontvangt een bijstandsuitkering van de gemeente. De gemeente heeft namens verzoekster de schuldeisers een schuldregeling aangeboden, inhoudende dat de kredietbank aan verzoekster een saneringskrediet van € 1.700,00 verstrekt, waaruit aan de preferente en concurrente schuldeisers een uitkering wordt gedaan van respectievelijk 39,09 % en 19,55 % tegen finale kwijting van het restant van hun vorderingen. De aangeboden schuldregeling is door vier schuldeisers aanvaard; alleen Orange is daarmee niet akkoord gegaan.           
De rechtbank overweegt dat het verzoek slechts zal kunnen worden toegewezen als Orange in redelijkheid niet tot weigering van instemming met de schuldregeling heeft kunnen komen. Hiervan kan pas sprake zijn als duidelijk is dat de crediteuren in een gedwongen schuldregeling een hogere dan wel snellere aflossing krijgen dan in een wettelijk traject te verwachten is.     
Niet aannemelijk is geworden dat verzoekster niet in staat is in de nabije toekomst arbeid te verrichten. Er is daarom een reële kans dat verzoekster ‘afloscapaciteit’ zal verwerven, waardoor er, al dan niet in een wettelijke schuldsaneringsregeling, uitzicht is op een hogere aflossing op haar schuld aan Orange dan nu is aangeboden.

 

Onder die omstandigheden kan niet worden geoordeeld dat Orange in redelijkheid niet tot weigering van instemming met de schuldregeling heeft kunnen komen. Daarbij wordt in aanmerking genomen dat de vordering van Orange ruim een derde deel uitmaakt van de totale schuldenlast van verzoekster. Het verzoek om Orange te bevelen in te stemmen met de schuldregeling zal daarom worden afgewezen.

When you have found a magazine of your likings, add that page to your favorites so you can easily go to that starting point directly from your profile during future visits. Below you will find some start magazines per field of study
  2. Use the topics and taxonomy terms
    • The topics and taxonomy of the study and working fields gives you insight in the amount of summaries that are tagged by authors on specific subjects. This type of navigation can help find summaries that you could have missed when just using the search tools. Tags are organised per field of study and per study institution. Note: not all content is tagged thoroughly, so when this approach doesn't give the results you were looking for, please check the search tool as back up
  3. Check or follow your (study) organizations:
    • by checking or using your study organizations you are likely to discover all relevant study materials.
    • this option is only available trough partner organizations
  4. Check or follow authors or other WorldSupporters
    • by following individual users, authors  you are likely to discover more relevant study materials.
  5. Use the Search tools
    • 'Quick & Easy'- not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject.
