Casus
De verdachte is door het Hof veroordeeld tot 180 dagen gevangenisstraf, waarvan 126 dagen voorwaardelijk met een proeftijd van 2 jaar, en tot een geldboete van 1500 gulden, subsidiair 30 dagen hechtenis voor het volgende. De verdachte wordt schuldig geacht aan het medeplegen van een ander behulpzaam zijn bij het verblijven in Nederland terwijl verdachte weet dat het verblijf wederrechtelijk is, en dat met oog op winstvoordeel voor verdachte zelf. De raadsman van de verdachte meent dat artikel 197a Sr in strijd is met artikel 1, lid 1 Sr, omdat het niet aan het legaliteitsbeginsel voldoet. Hij gaat daarvoor in beroep bij de Hoge Raad.
Rechtsvraag
Is het ten laste gelegde op grond van artikel 197a Sr in strijd met het legaliteitsbeginsel?
Hoge Raad
De Hoge Raad oordeelt dat wat betreft de beschuldiging op grond van artikel 197a Sr de verdachte in het algemeen ontslag van de rechtsvervolging zou krijgen, omdat anders de rechtszekerheid met de voeten zou worden getreden. De individuele burger zou dan aan de hand van dit artikel vervolgd kunnen worden door politie of justitie, en dit geval is dat zeker niet juist. Dat is ook vastgelegd in artikel 7 EVRM. Maar in dit geval zijn er bij de feiten van de zaak van de verdachte geen middelen die tot cassatie kunnen leiden, en ook het hof heeft geen fouten gemaakt in haar ambt. Het beroep wordt dus verworpen.
Commentaar
Op zich is artikel 197a Sr in strijd met onder andere artikel 1, lid 1 Sr, en zou daardoor er ontslag van rechtsvervolging moeten plaatsvinden voor de verdachte. Maar in deze zaak ontbreken de middelen. Je kunt dus stellen dat verdachte en raadsman de verkeerde middelen hebben ingediend in het hoger beroep, en op grond van die middelen kan dus niet het ontslag plaatsvinden. Dus kan de Hoge Raad niet anders dan het beroep verwerpen.
