Hoofdstuk 1 Inleiding
Kraepelin vestigde een psychiatrische ziekteleer (nosologie) die hij baseerde op strikte criteria voor de indeling van psychiatrische stoornissen, zoals oorzaak, verschijningsvorm (symptomen en syndromen), beloop van de stoornis in de tijd en prognose en eventuele specifieke patholooganatomische bevindingen na overlijden. Hierna zijn vele theorieën ontwikkeld ter verklaring van afwijkend gedrag c.q. gedragsstoornissen, zoals de psycho-analytische theorie, leertheorie, antropologie, sociale psychologie en systeemtheorie.
De natuurwetenschappelijke denkwijze wordt gekenmerkt door een empirisch-statistisch onderscheid tussen normaal en abnormaal, d.w.z. dat wat ‘meetbaar’ afwijkt van de norm wordt als abnormaal beschouwd. De fenomenologie, ook wel het hermeneutische onderzoeksontwerp genoemd, verzet zich tegen deze benadering. Zij legt de nadruk op de abnormale (inter)subjectieve ervaring. Abnormaal is de ervaring waarin een overeenstemmende intermenselijke ervaringssamenhang wordt doorbroken. Anders gezegd, de mens maakt niet alleen deel uit van de levende natuur, die zich bij uitstek empirisch laat onderzoeken. De mens is tevens ook zingever in en aan zijn eigen werkelijkheid en ontleent ook zin aan de wereld om hem heen. Zij maakt het reduceren van de onderzoeksbevindingen tot een ‘enkelvoudige’ psychiatrische diagnostische term ontoelaatbaar.
Een eerste indeling van psychische stoornissen werd in 1900 door Kraepelin gemaakt. Hij maakte een psychische ziekteleer (nosologie) die gebaseerd was op oorzaak, verschijningsvorm (symptomen), tijd en prognose en eventuele specifieke bevindingen na het overlijden. De fenomenologie liet echter zien dat dingen meerdere oorzaken kunnen hebben. Daarom werd toen door de American Psychiatric Association (APA) het classificatiesysteem Diagnostic and Statistical Manual of Mental Disorders (DSM) gemaakt. Deze moest zorgen voor zoveel mogelijk overeenstemming onder vakgenoten over stoornissen.
Het forensisch psychiatrisch onderzoek verschilt op een aantal punten met de reguliere arts-patiëntverhouding. Zo vindt het onderzoek plaats in het kader van de rechtspraak, de vraag om een onderzoek gaat meestal niet uit van de persoon die onderzocht moet worden maar van de rechter. Er is sprake van een beperkte vrijwilligheid bij het toestaan en het ondergaan van het onderzoek. Betrokkene moet op de hoogte zijn van het feit dat hij het recht heeft het onderzoek te weigeren.
In wettelijke zin kregen de gedragskundige disciplines erkenning bij de wetswijziging van 1988: van TBR naar TBS. Hierbij werd o.a. bepaald dat voor de oplegging van een terbeschikkingstelling met bevel tot verpleging van overheidswege rapportage vereist was van twee gedragskundigen van verschillende disciplines, onder wie een psychiater. Hetzelfde gold voor het uitbrengen van adviezen over de verlenging van TBS.
Forensische psychiatrie kan naast het strafrecht ook gebruikt worden in het jeugdrecht, het bestuursrecht en het civielrecht.
