TentamenTickets: Tips & Tricks bij het voorbereiden op tentamens
- Theoretische onderwerpen die van belang worden geacht bij bestuursrecht, zijn: de uitgangspunten, de constitutionele grondslag, het systeem en instrumenten; praktische onderwerpen die bestuursrechterlijk de aandacht genieten zijn: het functioneren van voorprocedures en de rechterlijke toetsing.
- Een aantal afdelingen binnen de Awb zijn van belang. Markeer daarom de belangrijkste wetsartikelen en markeer de titels en afdelingen die van belang zijn en voorzie deze van tabs.
Zorg ervoor dat je de volgende vragen voor het tentamen kunt beantwoorden:
Leg uit waarom de Afdeling bestuursrechtspraak van de Raad van State de bevoegde instantie is in hoger beroep?
Is de geschetste gang van zaken overigens in overeenstemming met de Awb?
Langs welke wegen zou appellant onder deze omstandigheden kunnen proberen de schade vergoed te krijgen die het gevolg is van...?
Wat wordt bedoeld met incidenteel appèl?
Stelling: Het verbod op reformatio in peius staat er niet aan in de weg dat een procedure van administratief beroep als uitkomst heeft dat het bestreden besluit ten nadele van de indiener van het administratief beroep wordt gewijzigd. Is deze stelling juist?
Het is handig om mee te doen aan de bonusregeling. In verleden jaren omvatte bonusopdracht 3 het schrijven van een verzoekschrift of beroepschrift en deze vraag kwam ook op het tentamen terug. Het is daarom handig om te weten welke elementen in het beroepschrift of verzoekschrift terug moeten komen, zodat je deze op het tentamen allemaal noemt. Het is namelijk niet heel moeilijk om die punten te noemen, waardoor je hiermee makkelijk punten kunt verdienen.
Er wordt iedere week één onderwerp behandeld. Het is handig om deze volgorde ook aan te houden bij het leren van het tentamen, want de vragen op het tentamen komen altijd overeen met een onderwerp uit een van de collegeweken. Het is handig om te herkennen in welke collegeweek de stof werd behandeld, zodat je de stof in je hoofd kunt filteren per week en daardoor makkelijker op een antwoord komt.
Los van de werkgroepen zijn ook de hoorcolleges van belang bij dit vak, omdat ze de structuur en hoofdlijnen van de stof behandelen maar ook omdat ze bepaalde begrippen verder behandelen die minder duidelijk in het boek naar voren komen, zoals het verbod van reformatio in peius en het Benthem-arrest
