Casus
De burgemeester en wethouders van Arnhem trekken op 16 december 1997 bij besluit een eerder gegeven aanwijzingsbesluit van 20 april 1993 in, dat een concentratiegebied voor raamprostitutie aanwees in het Spijkerkwartier. De intrekking zou per 1 december 2000 gaan gelden.
Het college B&W stelt dat het ingetrokken aanwijzingsbesluit moet worden gezien als een algemeen verbindend voorschrift. Wanneer dat zo is, kan tegen het besluit geen beroep en bezwaar worden ingesteld. De grondslag van het aanwijzingsbesluit is art. 102a van de APS (algemene plaatselijke strafverordening), dat luidt:
- Het is aan personen van wie redelijkerwijs kan worden aangenomen dat deze zich overgeven aan prostitutie, verboden zich binnenshuis op een van de openbare weg of de openbare grond of zichtbare plaats op zodanige wijze achter of in een raam of deuropening te bevinden dat redelijkerwijze kan worden aangenomen dat deze zich aldaar ophouden om tot ontucht uit te nodigen.
- Het bepaalde in het eerste lid geldt niet op plaatsen welke door de burgemeester en wethouders bij openbare kennisgeving zijn aangewezen, indien de door burgemeester en wethouders daarbij gestelde voorschriften worden opgevolgd."
ABRvS
De rechtbank deelt de mening van B&W niet. Zij ziet het besluit van 20 april 1993 als een besluit van algemene strekking (BAS). De ABRvS bevestigt die zienswijze. Het genoemde besluit bevat geen zelfstandige normstellingen en strekt niet verder dan het bepalen van de werkingssfeer van een reeds bestaande, algemenere norm (hier art. 102a APS). Omdat het hier gaat om niet meer dan de onttrekking van een bepaald gebied aan de werking van het in de APS neergelegde verbod op raamprostitutie, kan het aanwijzingsbesluit slechts worden gezien als een concretiserend besluit van algemene strekking. Tegen dit soort besluiten staat wel bezwaar en beroep open. De ABRvS spreekt ook nog van het onzelfstandige karakter van de aanwijzing, omdat deze niet meer is dan een concretisering van de in het tweede lid van art. 102a APS. De aanwijzing gaat niet verder dan de algemene plaatselijke strafverordening waardoor het geen zelfstandige rechtsnorm behelst.
