Vreemdelingenbewaring; strafrechtelijke voortraject
De rechter in vreemdelingenzaken kan niet oordelen over de aanwending van niet bij of krachtens de Vw toegekende bevoegdheden (hier: de bevoegdheid tot strafrechtelijke ophouding).
Slechts indien de onrechtmatigheid van die aanwending (door de straf)rechter is vastgesteld, kan de vreemdelingenrechter zich gesteld zien voor de vraag naar de consequenties daarvan voor de rechtmatigheid van de inbewaringstelling.
