Nalatige inspecteur (HR 02-10-1979, NJ 1980, 243)
Casus
Een opsporingsambtenaar constateerde op heterdaad een parkeer-overtreding ex art. 81 lid 2 aanhef en onder a RVV (oud) en zag de automobilist (verdachte) naar de op het trottoir geparkeerde auto toelopen. De opsporingsambtenaar vroeg aan de verdachte of hij eigenaar en houder van het voertuig (een Lada) was. De verdachte verklaarde: ik ben eigenaar en houder van deze auto en heb deze geplaatst als hij nu staat. De opsporingsambtenaar relateerde bovenstaande in een ambtsedig opgemaakt p.v. dat de Rechtbank voor de bewezenverklaring had gebezigd. Aan de HR werd gevraagd een oordeel te geven ten aanzien van de rechtsvraag of de Rb dit p. v. voor de bewezenverklaring mocht bezigen, nu de opsporingsambtenaar aan de verdachte niet de mededeling ex art. 29 lid 2 Sv had gedaan.
Hoge Raad
De vraag van de verbalisant aan de verdachte of hij eigenaar en houder van bedoeld voertuig was en of hij dat voertuig zo had geplaatst als verbalisant het had aan getroffen onder de bijzondere omstandigheden als vraag van verhoor moet worden aangemerkt.
De Rb had in haar vonnis feitelijk vastgesteld dat de mededeling ex art. 29 lid 2 Sv achterwege was gebleven. De verklaring van de verdachte had slechts als bewijsmiddel mogen meewerken indien de Rb tevens als vaststaand had aangenomen dat de verdachte door het ontbreken van de mededeling niet in zijn belang kon zijn geschaad (relativering van nietigheid). De Rb had in haar vonnis hieromtrent niets vastgesteld. De HR vernietigt derhalve het bestreden vonnis.

In het arrest plastic boodschappentasje (HR 29-9-1981 NJ 1982:258, verplicht) heeft de HR bepaald dat een gesprek op straat (in casu vroegen surveillerende agenten een hun bekende persoon, die op straat liep, wat er in de plastic tas zat die hij droeg waarop deze persoon antwoordde 'boeken', waarna de agenten vroegen waar hij deze had gekocht), geen verhoor is als bedoeld in art. 29 lid 2, dus ook de cautie niet gegeven behoefde te worden, er was immers nog geen sprake van een verdachte.
