Hennepkwekerij (HR 11-04-2006, NJ 2006, 393)
Casus
In deze zaak gaat het om de reikwijdte van art. 359 lid 2 Sv (na 1-1-2005). Verdachte is door het hof veroordeeld wegens deelnemen aan een criminele organisatie en schending van de Opiumwet. Verdachte gaat in cassatie. Het eerste middel klaagt dat het hof de bewezenverklaring van deelnemen aan een criminele organisatie ontoereikend heeft gemotiveerd, althans dat het hof niet heeft gerespondeerd op het verweer dat er geen sprake was van een criminele organisatie (gezien art. 359 lid 2 Sv).
Het hof had bewezen verklaard dat verdachte "heeft deelgenomen aan een organisatie, bestaande uit de verdachte en medeverdachte, welke organisatie tot oogmerk had het plegen van misdrijven...". De raadsman voerde aan dat er geen sprake was van een criminele organisatie. Er zou niets meer gebeurd zijn dan dat zijn cliënt samen met zijn zoon een handel in softdrugs had gedreven. Er zou geen hiërarchie bestaan die kwalificeerbaar zou zijn als criminele organisatie, gezien de jurisprudentie van de Hoge Raad. Het hof had echter niet gerespondeerd op dit verweer.
Kern
Met de komst van het nieuwe artikel is bijgekomen dat, indien de het Openbaar Ministerie t.z.v. onderwerpen (voorvragen, de kwalificatie en de strafbaarheid van feit en dader), "uitdrukkelijk onderbouwde standpunten" heeft ingenomen en de rechter daarvan afwijkende beslissingen neemt, dienaangaande nader moet zijn gemotiveerd. Ook m.b.t. de bewijsbeslissing en de oplegging van straf/maatregel moet worden gemotiveerd, in het geval dat de rechter afwijkt van de door verdachte of OM "uitdrukkelijk onderbouwde standpunten".
De komst van artikel 359 lid 2 Sv vereenvoudigt de gang van zaken. Elk verweer dat de strekking heeft van een kwalificatieverweer (dat betoogt dat de vaststaande feiten niet het tenlastegelegde feit opleveren) vereist een respons!
