Casus

Op 25 september 2000 hebben B&W van Epe een verzoek om vernietiging van een op appellant betrekking hebbend dossier afgewezen. Bij besluit van 25 januari 2001 hebben burgermeester en wethouders het door de appellant daartegen gemaakte bezwaar ongegrond verklaard.

 

Rechtbank en ABRvS

Op 29 oktober 2001 heeft de rechtbank te Zutphen het door appellant daartegen(dus tegen het besluit) ingestelde beroep ongegrond verklaard. Tegen deze uitspraak heeft de appellant bij brief, bij de RvS ingekomen op 7 december 2001, hoger beroep ingesteld. De afdeling bestuursrechtspraak van de RvS besluit dat de uitspraak van de rechtbank te Zutphen van 29 oktober 2001 vernietigt moet worden. Het besluit van de B&W van Epe van 25 januari 2001 ook en verklaart het bezwaar wordt niet-ontvankelijk. Ook bepaalde de afdeling bestuursrechtspraak van de RvS dat deze uitspraak in de plaats treedt van het vernietigde besluit. Als laatste moeten de gemeente Epe aan de appellant de gemaakte griffiekosten betalen.

 

Conclusie

Het vernietigen van archiefbescheiden betreft feitelijk handelen. Weliswaar zijn door de Archiefwet 1995 en de daarop gebaseerde regelingen regels gesteld met betrekking tot dit feitelijk handelen, maar dat brengt niet met zich dat een beslissing van B&W tot het al dan niet vernietigen van archiefbescheiden een publiekrechtelijke rechtshandeling inhoudt. B&W handelen in dit verband enkel in het kader van hun wettelijke zorgplicht voor archiefstukken. Het vernietigen van archiefbescheiden is als zodanig niet gericht op het in het leven roepen en of te niet doen van rechtsgevolgen, zoals een recht op inzage.

    • The topics and taxonomy of the study and working fields gives you insight in the amount of summaries that are tagged by authors on specific subjects. This type of navigation can help find summaries that you could have missed when just using the search tools. Tags are organised per field of study and per study institution. Note: not all content is tagged thoroughly, so when this approach doesn't give the results you were looking for, please check the search tool as back up
  3. Check or follow your (study) organizations:
    • by checking or using your study organizations you are likely to discover all relevant study materials.
    • this option is only available trough partner organizations
  4. Check or follow authors or other WorldSupporters
    • by following individual users, authors  you are likely to discover more relevant study materials.

    • 'Quick & Easy'- not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject.
