College 7: Hoe is schadevergoeding geregeld?
Welke onderwerpen worden behandeld in het hoorcollege?
Uitgangspunt en doelen schadevergoedingsrecht: uitgangspunt is volledige vergoeding, indien iemand aansprakelijk kan worden gesteld. De belangrijkste doelen van het schadevergoedingsrecht zijn compensatie en rechtshandhaving. Nevendoelen zijn genoegdoening en preventie.
Schade begripsvorming: de beschrijving ‘vermindering in een object’ dekt het meest de lading van het begrip schade.
Schadebegroting: art. 6:79 stelt dat concreet begroten het uitgangspunt is. Abstract begroten betekent dat je geabstraheerd van bepaalde concrete omstandigheden (objectieve herstelkosten). Dit is een uitzonderingsgeval, bijvoorbeeld bij zaaksbeschadiging, gemiddelde kosten opvoeding (arrest Wrongfulbirth) en verplaatste schade (art. 6:107).
Smartengeld: art. 6:106 stelt dat voor nadeel dat niet in vermogensschade bestaat, naar billijkheid moet worden vastgesteld. Uitgangspunt is de direct benadeelde. Sub b is het meest van belang en stelt dat de benadeelde die lichamelijk letsel heeft opgelopen, in zijn eer of goede naam is geschaad of op andere wijze in zijn persoon is aangetast recht heeft op schadevergoeding.
Gesloten stelsel van schadevergoeding: alleen de benadeelde heeft recht op schadevergoeding. Hier zijn uitzonderingen op in de artikelen 6:107, 6:107a en 6:108. In deze artikelen krijgt een beperkte kring personen als derden in een beperkt aantal schadesoorten recht op schadevergoeding.
Arrest Taxibus: opening dat niet enkel de direct benadeelde recht heeft op schadevergoeding. Dit is enkel in het geval als aan de 6 vereisten is voldaan. Als aan deze vereisten is voldaan, kan je als derden in aanmerking komen voor shockschade en de kosten die daarmee samenhangen. Vanaf 2019 is dit recht voor een derde op schadevergoeding versoepelt.
