Duurzame ontwrichting (HR 06-12-1996, NJ 1997, 189)
Casus
Een man verzoekt de rechtbank een echtscheiding tussen hem en zijn vrouw uit te spreken. Volgens de man is het huwelijk namelijk duurzaam ontwricht. Zijn vrouw voert hiertegen verweer, volgens haar is er geen sprake van duurzame ontwrichting. Hun huwelijkscrisis zou te wijten zijn aan factoren die buiten het huwelijk liggen. Zij denkt dat haar man gezien zijn psychisch labiele situatie wilsonbekwaam is. Als haar man maar deskundige hulp krijgt zal hij vanzelf wel inzien dat er geen sprake is van een duurzame ontwrichting van het huwelijk en zou de huwelijkscrisis zelfs overwonnen kunnen worden. Ondanks het verweer van de vrouw spreekt de rechtbank de echtscheiding toch uit en het Hof in hoger beroep bekrachtigd de beschikking.

Geeft het Hof met zijn oordeel over duurzame ontwrichting blijk van een onjuiste rechtsopvatting?
Hoge Raad
Het Hof geeft geen blijk van een onjuiste rechtsopvatting want volgens het standpunt van de regering, bij de behandeling van het (thans geldende) echtscheidingrecht, moet worden aangenomen dat als de eisende echtgenoot onder aanvoering van gronden stelt dat en blijft stellen dat hij hoe dan ook met zijn echtgenoot niet meer kan samenleven, dit door de rechter moet worden opgevat als een zeer ernstige aanwijzing dat de toestand van duurzame ontwrichting inderdaad bestaat.
