Valkenhorst - Arrest
Valkenhorst (HR 15-04-1994, NJ 1994, 608)
Feiten
I.c. gaat het om een zaak tussen R (de dochter), eiseres tot cassatie, tegen Stichting Valkenhorst, verweerster in cassatie.
De dochter R. was, als buitenechtelijk kind, in 1935 geboren in ‘Moederheil’ (later Valkenhorst). Dit was een door rooms-katholieke religieuzen gedreven inrichting met als doelstelling het verlenen van zorg en begeleiding aan ongehuwde moeders en hun kinderen. De dochter wilde inzage in de gegevens van haar overleden moeder om zo eventueel duidelijk te krijgen wie haar vader was. De inrichting weigerde inzage in de gevraagde gegevens met een beroep op haar zwijgplicht. Voorts stelde het dat de gevraagde gegevens alleen werden bekendgemaakt als er vooraf uitdrukkelijk toestemming door de moeder was gegeven. Daar was hier geen sprake van.
Kern van het geschil dat toen volgende was de vraag of Valkenhorst de verstrekking van de gevraagde gegevens afhankelijk mocht maken van de toestemming van de moeder. Het Hof beantwoorde dit bevestigend. Daartegen richt zich het middel.
Het Hof Den Bosch ging uit van drie tegenstrijdige belangen, namelijk het belang van de vrouw om te weten van wie zij afstamt, het maatschappelijk belang en tenslotte de bescherming van de privacy van de overleden vrouw.
Volgens het Hof is de geheimhouding na de dood niet absoluut is en dat ook in het geval dat de toestemming van de overledene niet kan worden verondersteld, is openbaring van diens gegevens op grond van belangenafweging soms verplicht.
Hoge Raad
Prevaleert het recht om te weten van wie je afstamt (art. 7 VN – Kinderrechtenverdrag) boven het recht op privacy (Art. 8 EVRM)?
De Hoge Raad oordeelde dat: “Het aan grondrechten als het recht op respect voor het privé leven, het recht op vrijheid van gedachte, geweten en godsdienst en het recht op vrijheid van meningsuiting ten grondslag liggende algemene persoonlijkheidsrecht, omvat mede het recht om te weten van welke ouders men afstamt.”
De Hoge Raad noemt een persoonlijkheidsrecht dat niet absoluut is en zodra deze bots met andere persoonlijkheidsrechten moet er een afweging worden gemaakt. Volgens de Hoge Raad had het hof teveel gewicht aan het maatschappelijk belang toegekend. De Hoge Raad achtte dit maatschappelijk belang bijna niet aanwezig. Het persoonlijkheidsrecht om te weten van wie je afstamt, gaat volgens de Hoge Raad voor het persoonlijkheidsrecht op de privacy van de moeder.
