In zijn beschikking van 31 mei 2002 (ECLI:NL:HR:2002:AE0745; NJ 2002, 470) heeft de Hoge Raad geoordeeld dat vanaf het moment waarop een verzoek tot het verlenen van vervangende toestemming tot erkenning van het kind bij de rechtbank is ingediend (artikel 1:204 lid 3 BW) en totdat daarop definitief is beslist, de moeder aan een ander slechts voorwaardelijk toestemming tot erkenning kan verlenen en dat die toestemming in dat geval alleen gevolg heeft indien de door de verwekker gevraagde vervangende toestemming bij een definitief geworden rechterlijke beslissing is geweigerd. Moet die regel ook worden aanvaard in het geval de verwekker door middel van een brief van een advocaat aan de moeder om toestemming tot erkenning heeft verzocht?
Ook in het geval de verwekker door middel van een brief van een advocaat aan de moeder toestemming tot erkenning heeft verzocht, moet worden aangenomen dat een daarna door de moeder aan een andere man gegeven toestemming tot erkenning slechts een voorwaardelijk karakter heeft zolang niet een (nadien) door de verwekker verzochte vervangende toestemming bij een definitief geworden rechterlijke beslissing is geweigerd.
De verwekker dient dat verzoek om vervangende toestemming bij de rechtbank uiterlijk drie maanden na de dag waarop de brief van de advocaat aan de moeder is verzonden in te dienen, bij gebreke waarvan een door de moeder aan een andere man gegeven toestemming onvoorwaardelijk wordt.
