Edamse bijstandsvrouw (HR 09-01-1987, NJ 1987, 928; AB 1987, 231)
Casus
G. is een gescheiden vrouw met drie kinderen. Zij ontving sedert 1977 een aanvullende bijstandsuitkering. B en W-college van Edam heeft in 1983 deze uitkering ingetrokken omdat er vanuit gegaan werd dat G. samenwoonde met de heer E. en aldus geen aanvullende bijstand meer nodig had. In een beroepsprocedure bij GS Noord-Holland het college van B en W in het ongelijk gesteld, waarna de uitkering is hervat.
G. heeft K., adjunct directeur van de GSD Edam, gedagvaard voor kort geding rechter en gevorderd dat K. zich onthoudt van aantekening te houden over haar gedrag en haar relaties en daaromtrent mededeling te doen aan derden, alles onder verbeurte van een dwangsom van fl 10.000,- voor iedere keer dat K. dit verbod overtreedt.
Rechtsvraag
In hoeverre speelt art. 8 EVRM (recht op eerbiediging van de persoonlijke levenssfeer) hier een rol?
Hoge Raad
Volgens de HR is, gezien de feiten, hier terecht sprake van een inbreuk op de persoonlijke levenssfeer van G. en daarmee schending van het in art. 8 EVRM (art. 10 G..W.) bepaalde. Dit brengt evenwel nog niet mee dat K. onrechtmatig heeft gehandeld. Art. 8 lid 2 EVRM biedt rechtvaardigingsgrond, ongeschreven of geschreven.
De vraag of hier een rechtvaardigingsgrond is, is mede afhankelijk van een waardering van de feiten.
In deze situatie moet het belang van G. op eerbiediging van de persoonlijke levenssfeer afgewogen worden tegen het belang dat de GSD ter controle van de naleving van de Alg. Bijstandswet heeft.
Deze belangenafweging dient volgens de HR als volgt te geschieden: "...waardering van de ernst van die inbreuk (van de persoonlijke levenssfeer) tegenover het gewicht van dat belang, niks mede in aanmerking genomen omstandigheden als: de lengte van de periode waarover 'met een zekere regelmaat' door K de voormelde constateringen zijn gedaan en doorgegeven; het 'met zekere regelmaat' blijven verzamelen en doorgeven van deze gegevens, die van intieme aard waren, in verband met de vraag of zij iets nieuws brachten ten opzichte van de feiten die reeds bij de GSD bekend waren; het feit dat K het oordeel of het voorzetten van het verzamelen den doorgeven van die gegevens opportuun was, niet heeft overgelaten aan de daartoe bevoegde ambtenaren van de GSD; en in verband met dit alles ook het feit dat hij zowel buurman van G. was als adjunct-directeur van de GSD met het inzicht en de invloed die aan deze functie kon ontlenen.
