Casus
Italië heeft in 1962 de particuliere ondernemingen die elektriciteit produceren en distribueren bij wet genationaliseerd (verplichte overdracht aan de Staat). Een aandeelhouder van één van die genationaliseerde ondernemingen vecht in een procedure voor een Italiaanse rechter de rechtmatigheid van die nationalisatie aan, onder andere met een beroep op het EEG-verdrag. De Italiaanse rechter verzoekt het Hof van Justitie van de EEG om het EG-oprichtingsverdrag op dit punt uit te leggen. Het Hof doet dit in een zogenaamde prejudiciële beslissing (art. 177 EG-oprichtingsverdrag, inmiddels art. 267 VWEU).
HvJ
Het Hof overweegt dat het EEG-verdrag voorrang heeft boven het nationale recht van de lidstaten. Het EEG-verdrag heeft een eigen rechtsorde in het leven geroepen, die bij haar inwerkingtreding van rechtswege (automatisch) in de rechtsordes van de lidstaten is opgenomen. Hierin onderscheidt het EEG-verdrag zich van gewone internationale verdragen. De eigen rechtsorde heeft tot gevolg dat lidstaten niet tegen Europese wetgeving in kunnen gaan met een later, eenzijdig afgekondigd, wettelijk voorschrift. Nationale wetten die onverenigbaar zijn met het EEG-verdrag dient de nationale rechter buiten toepassing te laten. Het EEG-verdrag heeft dus voorrang boven het nationale recht.
Indien een nationale bepaling en een Europese bepaling tegenstrijdig zijn, heeft de Europese bepaling voorrang ten aanzien van de nationale bepaling. Dat is nodig omdat het Europees recht vereist dat de regels in alle lidstaten op dezelfde wijze moeten worden toegepast, omdat anders haar doelstellingen in gevaar zouden komen. Dit geldt in zowel monistische als dualistische lidstaten. Vandaar dat het Europees recht een eigen autonome rechtsorde in het leven heeft geroepen.
