Plaumann - HvJ EU - 1963 - Arrest
Casus
CV Plaumann & Co. heeft een beroep tot nietigverklaring ingesteld tegen de afwijzende beschikking van de Commissie van de Europese Economische Gemeenschap (22-05-1962) bij het Hof van Justitie van de Europese Gemeenschappen.
De beschikking wees het beroep van de Bondsrepubliek Duitsland om machtiging tot gedeeltelijke schorsing van de heffing van rechten op uid derde landen ingevoerde mandarijnen en clementines af. Tevens lag er een vordering van 39.414,01 Deutsche Mark. Het betrof hier het beroep tot nietigverklaring in artikel 263 van het Werkingsverdrag en kan worden ingesteld door lidstaten, het Europees Parlement, Commissie, Centrale Bank, Rekenkamer of Raad. Ook natuurlijke en rechtspersonen kunnen zo'n beroep instellen, maar alleen tegen handelingen die het individueel dan wel rechtstreeks raken of tegen hen gericht zijn.

Wanneer is er de beroepsmogelijkheid tegen een beschikking die tot een ander gericht is (oftewel, in hoeverre is Plaumann individueel geraakt door de beschikking)?
HvJ
Om daartegen beroep te kunnen instellen, is het niet voldoende dat men de gevolgen van die beschikking ondervindt. Men moet er individueel door worden geraakt, hetgeen betekent dat de beschikking betrokkenen raakt ‘uit hoofde van zekere bijzondere hoedanigheden of van een feitelijke situatie welke hem ten opzichte van een ieder ander karakteriseert en dus individualiseert op soortgelijke wijze als de adressaat’.
In casu raakt de bestreden beschikking de verzoekster in haar hoedanigheid van importeur van clementines, dat wil zeggen uit hoofde van commercieel beroep, hetgeen ten alle tijden door iedere justitiabele kan worden uitgeoefend en haar derhalve ten opzichte van de bestreden beschikking niet karakteriseert op soortgelijke wijze als een adressaat. Het Hof van Justitie van de EU is van oordeel dat verzoekster niet individueel geraakt is, aangezien de richtlijn voor iedere clementineimporteur geldt en verzoekster zich hiermee niet individualiseert van ieder ander.
