Nold (HvJ 11-01-1977, Zaak 4/73)
Casus
Vennootschap J. Nold die in Darmstadt een groothandel in steenkool en bouwmaterialen exploiteert heeft een beroep in gesteld tot vernietiging van de beschikking van de Europese Commissie ter goedkeuring van een nieuwe verkoopregeling van de Ruhrkohle AG. De Ruhrkohle-verkauf GmbH is gemachtigd om de rechtstreekse levering van steenkool afhankelijk te stellen van het sluiten van tweejarige overeenkomsten inzake een af te nemen minimumhoeveelheid van 6000 ton per jaar voor de huisbrand- en kleinverbruiksector welke hoeveelheid de jaaromzet van Nold ver te boven gaat waardoor zij als handelaar niet meer zou kunnen bestaan. Het betoog van Nold komt dus in feite neer op het inroepen van een schending wegens wezenlijke vormvoorschriften en schending van het verdrag of zijn uitvoerregelingen. Ook beroept zij zich op schendingen van fundamentele rechten, omdat de beperkingen in de regeling zozeer afdoen aan haar rentabiliteit en de vrijheid van haar economische werkzaamheid, dat zij in haar bestaan wordt bedreigd.
Rechtsvraag
Is het in strijd met het Europees recht en fundamentele beginselen om een regeling op te stellen die het bestaan van een onderneming onmogelijk maakt.
HvJ
De aan de onderneming verstrekte waarborgen mogen in geen geval meer worden uitgebreid tot de bescherming van de belangen of kansen van de handel welke wisselvalligheid voor de economische werkzaamheid wenselijk is. De nadelen in deze casus zijn niet meer dan een gevolg van economische ontwikkelingen en niet per definitie van de bestreden beschikking. Gezien de economische veranderingen waar de recessie bij steenkolenproductie toe moest leiden, had Nold moeten nadenken over een reconversie van haar bedrijf om het hoofd te kunnen blijven bieden aan de nieuwe situatie.
