Kempter (Case C-2/06) - Arrest
Kempter (HvJ 12-02-2008, Zaak C-2/06)
Kempter exporteert van 1990 tot en met 1992 runderen naar derde landen. Op grond van een toen geldende verordening nr. 3665/87 heeft Kempter uitvoerrestituties aangevraagd en ook gekregen. In 1995 zijn een aantal van de uitgegeven restituties terug gevorderd, omdat een aantal runderen het derde land niet levend hadden bereikt. Kempter ging hiertegen in beroep, maar deed geen beroep op het gemeenschapsrecht. Zijn beroep werd dan ook afgewezen. Ook het hoger beroep werd afgewezen, zodat de beslissing van de terugvorderrestituties vast stond.
21 maanden na het besluit verzoekt Kempter de zaak nog een keer te onderzoeken en het besluit te wijzigen door een in die tussentijd gewezen arrest. Naar aanleiding van deze zaak worden prejudiciële vragen gesteld.
Ten eerste de vraag: vereisen het heronderzoek en de intrekking van een definitief geworden bestuursbesluit, om rekening te houden met de uitlegging die het Hof van Justitie van de Europese Gemeenschapen inmiddels aan het relevante gemeenschapsrecht heeft gegeven, dat de betrokkene het besluit op grond van het gemeenschapsrecht voor de nationale rechter heeft aangevochten? En ten tweede: is een verzoek tot heronderzoek en intrekking van een definitief geworden bestuursbesluit dat in strijd is met het gemeenschapsrecht, afgezien van de in het arrest (Kühne en Heinz) gestelde voorwaarden, om dwingende reden van gemeenschapsrecht aan een termijn gebonden?
HvJEG
Het Hof is van mening dat de woorden uit het inmiddels gewezen arrest louter declaratoir en niet constitutief van aard zijn, zodat in beginsel de datum van inwerkingtreding van het uitgelegde voorschrift terugwerkt. Het feit dat een bestuurbesluit definitief is geworden na het verstrijken van een redelijke beroepstermijn of na uitputting van alle rechtsmiddelen, bijdraagt tot het rechtszekerheidbeginsel en dat het gemeenschapsrecht niet vereist dat een bestuursorgaan in beginsel moet terug komen op ene dergelijk definitief geworden bestuursbesluit. Een nationaal bestuursorgaan kan echter in bijzondere omstandigheden terug komen op een definitief geworden besluit in het licht van art. 10 EG. Derhalve wordt beslist dat het gemeenschapsrecht niet vereist dat de verzoekende partij in het hoofdgeding zich op dat recht heeft beroepen in het kader van het beroep in rechte dat zij naar nationaal recht tegen dat besluit heeft ingesteld. Op de tweede vraag antwoord het hof als volgt: Het staat de lidstaten evenwel vrij om in overeenstemming met de communautaire beginselen van doeltreffendheid en gelijkwaardigheid redelijk beroepstermijn vast te stellen.
