Leonesio (HvJ 17-05-1972, Case 93/71)

Mevrouw Leonesio, boerin, had in 1970 vijf koeien laten slachten waarna zij de bevoegde autoriteiten had verzocht om toekenning van een premie. Op grond van een verordening van de EG meende zij daar recht op te hebben. Het Italiaanse ministerie van landbouw plaatste daar kanttekeningen bij. De zaak werd voorgelegd aan het Hof van Justitie.

Zijn de bepalingen van de betreffende verordeningen binnen de nationale rechtsorde rechtstreeks toepasselijk en zo ja, hebben zij ten behoeve van particulieren subjectieve rechten doen ontstaan welke de nationale rechter dient te handhaven.

Hof van Justitie

Een gemeenschapsverordening heeft rechtstreekse werking en kan als zodanig aan particulieren rechten verlenen, die de nationale rechter verplicht is te beschermen, Zodra alle in de betreffende verordeningen genoemde voorwaarden waren vervuld, hadden de boeren krachtens deze verordeningen recht op betaling van de premie door de lidstaat, welk recht door de nationale rechter dient te worden gehandhaafd. De lidstaat kan zich noch door enige vorm van wetgeving noch door administratieve handelingen tegen deze betaling verzetten.
