Sanz de Lera (HvJ zaak C-163/94, 14/12/1995)
Feiten
Het Spaanse Hof (Audiencia Nacional) heeft een aantal prejudiciële vragen gesteld over de uitleg van de artikelen 73 B, 73 C, lid 1, en 73 D, lid 1, sub b, EG-Verdrag. Die vragen zijn gerezen in een strafzaak. Sanz de Lera, van Spaanse nationaliteit en wonende in Spanje, werd op 27 oktober 1993 in Frankrijk aangehouden, toen hij met zijn voertuig naar Genève (Zwitserland) reed. Hoewel hij verklaarde dat hij niets had aan te geven, doorzochten de Franse beambten zijn voertuig, waarin zij voor een bedrag van 19 600 000 peseta's aan bankbiljetten ontdekten. Omdat geen vergunning voor de uitvoer van die bedragen was aangevraagd, werd Sanz de Lera voor de Spaanse strafrechter gedaagd en de rechter wendde zich tot het Hof van Justitie met de prejudiciële vragen.
Hof van Justitie
1) De artikelen 73 B, lid 1, en 73 D, lid 1, sub b, EG-Verdrag verzetten zich tegen een nationale regeling die voor de uitvoer van geldstukken, bankbiljetten of cheques aan toonder in de regel een voorafgaande vergunning vereist, maar staan daarentegen niet eraan in de weg, dat voor een dergelijke verrichting een voorafgaande aangifte wordt vereist. Zo een regeling valt niet onder artikel 73 C lid 1 van het Verdrag.
2) De bepalingen van artikel 73 B, lid 1, juncto de artikelen 73 C en 73 D, lid 1, sub b, van het Verdrag kunnen voor de nationale rechter worden ingeroepen en kunnen tot gevolg hebben, dat de daarmee strijdige nationale bepalingen buiten toepassing worden gelaten.
Met andere woorden, het Hof oordeelde dat het onderwerp van uitvoer van geld door een Lidstaat aan een derde land aan de voorwaarde van voorafgaande toelating strijdig was, maar niet de aangifte daarvan.
Kern: Het verbod van artikel 63 Eu-Werkingsverdrag betreft een belemmeringverbod en heeft directe werking. In dit arrest werd geoordeeld dat niet valt onder artikel 73 C, lid 1, EG-Verdrag (thans artikel 64, lid 1, VWEU) een regeling die algemeen van toepassing is op elke uitvoer van geldstukken, bankbiljetten of cheques aan toonder, daaronder begrepen uitvoer die geen verband houdt met directe investeringen in derde landen, vestiging, het verrichten van financiële diensten of de toelating van waardepapieren tot kapitaalmarkten.
