Casus
De Luxemburgse Kohll is verzekerd bij een Luxemburgse (staats-)verzekeringsmaatschappij. Een in Luxemburg gevestigde arts heeft de verzekeringsmaatschappij verzocht om toestemming te verlenen voor een orthodontische behandeling van Kohlls minderjarige dochter in Duitsland. Dit verzoek is afgewezen op de grond dat de voorgenomen behandeling niet spoedeisend was en ook in Luxemburg kon worden verleend.
In Luxemburg is er een regeling die bepaalt dat verzekerden behoudens in geval van spoedeisende hulp wegens een ongeval in het buitenland of een aldaar optredende ziekte, zich uitsluitend na voorafgaande toestemming van het bevoegde sociale-zekerheidsorgaan in het buitenland mogen laten behandelen of zich mogen wenden tot een buitenlandse zorginstelling of leverancier van hulpmiddelen.

Is deze nationale regeling in strijd met de artikelen 49 en 50?

Het Hof blijkt ook voor het dienstenverkeer soms bereid tot toetsing aan de Rule of Reason bij maatregelen met onderscheid, dwz niet gelijkelijk geldend voor het binnenlandse en het grensoverschrijdende dienstenverkeer. De artikelen 49 en 50 van het Verdrag verzetten zich tegen een nationale regeling die de vergoeding van de kosten van de tandheelkundige hulp door een in een andere lidstaat gevestigde orthodontist volgens het tarief van de lidstaat van verzekering afhankelijk stelt van de toestemming van het sociale zekerheidsorgaan van de verzekerde. Een dergelijke regeling schrikt de sociaal verzekerden af om zich tot medische hulpverleners in een andere lidstaat te wenden, en vormt zowel voor laatstgenoemden als voor hun patiënten een belemmering van het vrij verrichten van diensten. Zij is noch wegens het risico van een ernstige aantasting van het financiële evenwicht van het sociale-zekerheidsstelsel gerechtvaardigd, aangezien de vergoeding van de kosten van in andere lidstaten verleende tandheelkundige hulp volgens de tarieven van de staat van verzekering geen belangrijke invloed heeft op de financiering van het sociale-zekerheidsstelsel, noch om redenen van volksgezondheid in de zin van de artikelen 46 en 55 van het Verdrag, te weten bewaking van de kwaliteit van de in andere lidstaten verleende medische hulp en handhaving van een evenwichtige en voor eenieder toegankelijke verzorging door artsen en ziekenhuizen. Dit omdat door harmonisatie de medische hulp in de lidstaten gelijke waarborgen te biedt als de medische hulp in de eigen lidstaat.
