Toetreding EG tot EVRM (HvJ 28-03-1996, Opinie 2/94)
Deze opinie betreft de toetreding van de Gemeenschap tot het EVRM. De toetreding van de Gemeenschap tot het EVRM riep voornamelijk twee vragen op. Enerzijds de vraag naar de bevoegdheid van de Gemeenschap om een dergelijk akkoord te sluiten, en anderzijds de vraag naar de verenigbaarheid ervan met de bepalingen van het Verdrag, in het bijzonder die betreffende de bevoegdheden van het Hof.

Kan de toetreding van de gemeenschap tot het EVRM op artikel 235 worden gebaseerd?
De bevoegdheid van de Gemeenschap om tot het EVRM toe te treden
De Gemeenschap beschikt slechts over geattribueerde bevoegdheden, zo blijkt uit artikel §B van het verdrag, dat de Gemeenschap handelt binnen de grenzen van de haar door het Verdrag verleende bevoegdheden en toegewezen doelstellingen. Dit beginsel van attributie van bevoegdheid moet zowel bij het interne als het internationale optreden van de Gemeenschap worden geëerbiedigd. De Gemeenschap handelt gewoonlijk op basis van specifieke bevoegdheden die, zoals het Hof heeft geoordeeld, niet noodzakelijkerwijs uitdrukkelijk moeten voortvloeien uit specifieke bepalingen van het Verdrag, maar die er ook impliciet uit kunnen voortvloeien.
Op het gebied van de internationale betrekkingen van de Gemeenschap kan volgens vaste rechtspraak de bevoegdheid van de Gemeenschap tot het aangaan van internationale verbintenissen niet enkel op uitdrukkelijke bepalingen van het Verdrag berusten, maar ook impliciet uit die bepalingen voortvloeien. Telkens wanneer het gemeenschapsrecht de instellingen op intern vlak bevoegdheden toekent om een bepaald doel te verwezenlijken, is de Gemeenschap bevoegd de ter verwezenlijking van dat doel noodzakelijke internationale verbintenissen aan te gaan, ook indien een uitdrukkelijke bepaling ter zake ontbreekt.
Momenteel is er geen enkele bepaling van het Verdrag dat de gemeenschapsinstellingen in algemene zin bevoegd verklaart om regels te stellen op het gebied van de mensenrechten of om internationale akkoorden op dit gebied te sluiten.
Toetreding tot het EVRM zou een ingrijpende wijziging van het huidige communautaire stelsel van bescherming van de mensenrechten betekenen, omdat de Gemeenschap daarmee deel zou gaan uitmaken van een apart internationaal institutioneel bestel en alle bepalingen van het EVRM in de communautaire rechtsorde zouden worden opgenomen. Die wijziging zou ingrijpend zijn, een constitutionele dimensie hebben en naar de aard van de grenzen van artikel 235 te veel zijn. Dit kan dus enkel worden bewerkstelligd door een wijziging in het verdrag.
