Faunabescherming Fryslân (HR 01-10-2014, ECLI:NL:HR:2004:AO8913)
Casus
Op 1 april 2002 is de Flora- en Faunawet in werking getreden. Artikel 9 verbiedt dieren, behorende tot een beschermde diersoort, te doden, te verwonden, te vangen, te bemachtigen of met het oog daarop op te sporen. Artikel 10 bepaalt dat het verboden is dieren, behorende tot een beschermde inheemse diersoort, opzettelijk te verontrusten. De Provinciale Staten van Fryslân hebben gebruik gemaakt van de in artikel 65 lid 4 Flora- en Faunawet geboden mogelijkheid, welke bepaalt dat er diersoorten die volgens artikel 65 lid 2 Flora- en Faunawet niet in hun voortbestaan bedreigd worden, mogen worden gedood, verwond of gevangen in de zin van artikel 9 jo. 10 Flora- en Faunawet, om een dergelijke verordening uit te vaardigen. In kort geding is gevorderd dat de Provincie die verordening weer moet intrekken, terwijl in cassatie ter discussie staat of de rechter een bevel tot het intrekken van een verordening kan geven.
Hoge Raad
De Hoge Raad heeft gebruik gemaakt van de argumenten uit het Waterpakt/ Staat-arrest, inhoudende:
De vraag of, wanneer en in welke vorm een wet tot stand zal komen moet worden beantwoord op grond van een politieke besluitvorming en afweging van de daarbij betrokken belangen.
De op de Grondwet berustende verdeling van bevoegdheden van de verschillende staatsorganen brengt mee dat de rechter niet vermag in te grijpen in de procedure van de politieke besluitvorming.
Ook indien de wetgever heeft nagelaten binnen de implementatietermijn bepaalde wetgeving vast te stellen om het door die richtlijn vereiste resultaat te bereiken en moet worden aangenomen dat de Staat daarmee onrechtmatig handelt jegens de eisende partij.
Het buiten toepassing laten van wetgeving in formele zin op grond van artikel 94 Grondwet heeft een ander karakter dan het geven van een rechterlijk bevel om bepaalde wetgeving tot stand te brengen.
In casu heeft de Hoge Raad beoordeeld dat de burgerlijke rechter geen bevel tot intrekking van de nationale verordening mag geven, ook niet indien zou vaststaan dat de intrekking noodzakelijk is om de volle werking van de Vogelrichtlijn te verzekeren. De omstandigheid dat het hier niet om gaat om een wet in formele zin, maar om een provinciale verordening, staat hier niet aan in de weg.
