Casus
Op 28 mei 2002 heeft de regering van Congo een klacht ingediend tegen de republiek van Rwanda, vanwege een grove schending van mensenrechten en internationaal humanitair recht aan de kant van Rwanda. De regering van Congo was van mening dat de schendingen het gevolg waren van een gewapende daad van agressie op het territoir van Congo, waardoor de soevereiniteit en territoriale integriteit van Congo geschonden werden. Rwanda had namelijk een Boeing 727 neergeschoten waardoor 40 burgers waren gedood. Verder had Rwanda zich schuldig gemaakt aan het vermoorden, verkrachten, kruizigen en het doorsnijden van kelen van 3,5 miljoen Congolesen. Congo verzocht het Hof te erkennen dat Rwanda in strijd had gehandeld met het Handvest van de VN, artikel 2 lid 3 en 4, en verschillende andere internationaalrechtelijke instrumenten.
Hof
Het Hof begint met de vraag naar ontvankelijkheid. Het Hof bepaalt dat, voor de vraag of een Staat de jurisdictie van het Hof heeft aanvaard, de houding van een Staat gezien moet kunnen worden als een ondubbelzinnige indicatie van de wil van die Staat om de jurisdictie van het Hof op een vrijwillige en onbetwistbare manier te accepteren. Het Hof bepaalt dat het continuerende verzet van Rwanda tegen de jurisdictie van het Hof duidt op het niet accepteren van de jurisdictie. Verder bepaalt het Hof dat het feit dat Rwanda niet geweigerd heeft te verschijnen voor het Hof niet geïnterpreteerd kan worden als een houding als hierboven beschreven, omdat zij juist was verschenen om de jurisdictie te bestrijden.
Het Hof bepaalt dat het enkele feit dat er in casu rechten en plichten die voor iedereen gelden (erga omnes) aan de orde zijn niet betekent dat het Hof jurisdictie heeft. Het Hof bepaalt dat dit tevens geldt voor de relatie tussen jus cogens en de bepaling voor de jurisdictie van het Hof. Het Hof overweegt dat de jurisdictie van het Hof onder het Statuut altijd is gebaseerd op de instemming van partijen.
