Military and Paramilitary Activities in and Against Nicaragua (Nicaragua v. United States of America) (ICJ, 27-06-1986, EIR 493 (480, 431))
Casus
De V.S. had de rebellenbeweging Contra´s gefinancierd, georganiseerd, getraind, van wapens en materiaal voorzien en hadden zelfs bepaalde doelwitten voor hen geselecteerd. Het internationaal Gerechtshof moet over de vraag oordelen of de V.S. hierdoor internationaal aansprakelijk moet worden gehouden voor de daden van de Contra´s in Nicaragua.

Mag de VS zijn hulp aan de opstandelingen in El Salvador baseren op het collectieve zelfverdedigingsrecht?
Internationaal Gerechtshof
Het hof oordeelde dat in casu geen sprake kon zijn van een toerekening van de handelingen van de Contra´s aan de V.S. Indien de VS hiervoor internationaal aansprakelijk zou zijn, zou moeten worden bewezen dat `that State had effective control of the military and paramilitary operations in the course of which the alleged violations were committed`.
Het Internationaal Gerechtshof stelde dat de Verenigde Staten wel artikel 2§4 HVN hadden geschonden door wapens en training te verlenen aan de ‘Contra’s’ in Nicaragua. Alleen financiële steun daarentegen werd niet gekwalificeerd als indirect geweld, maar vormde wel een inbreuk op het ruimere verbod op interventie in de interne aangelegenheden van een Staat (zoals neergelegd in resoluties 2131 en 2625 van de Algemene Vergadering).
Volgens het Hof werden de volgende inbreuken gepleegd op regels van het internationaal gewoonterecht; het verbod om tussenbeide te komen in de aangelegenheden van een andere staat, het verbod geweld te gebruiken tegen een andere staat, het verbod om inbreuk te maken op de soevereiniteit door niet toegelaten vluchten te maken boven het grondgebied van een andere staat, het verbod om vredelievende maritiem handel te verbreken, het niet bekend maken van de plaatsen waar mijnen zijn gelegd, zijnde een gewoonterechtelijke regel van het recht van de gewapende conflicten.
Kern
In casu oordeelde het Internationaal Gerechtshof dat de Verenigde Staten gebonden zijn door het geweldverbod en het beginsel van niet-interventie, zowel op basis van verdragsrecht (VN-Handvest) als op basis van internationaal gewoonterecht.
