Stel vast wat het onderwerp van de tentamenvraag is, op deze wijze kan je makkelijk zoeken naar artikel, jurispudentie, literatuur en beginselen die van belang zijn voor de vraag
Elk vraag dien je te beantwoorden door middel van:
- Wetsartikel
- Nationale jurisprudentie
- Europese jurisprudentie
- Literatuur
- Beginselen (indien toepasbaar)
Van belang om goed te kennen bij Europees Recht zijn de volgende onderwerpen.
De rechtsbronnen van het Europees Recht
De organisatie van het Europees Recht.
De bevoegdheden van de organisatie
Het verschil tussen de Europese Raad en de Raad van Europa.
De drie pijlers van het Europees recht
- De 4 vrijheden
Belangrijkste is: Vrij verkeer van goederen + 3 arresten (art 26 t/m 37 VWEU)
Er bestaan uitzonderingen op de 4 vrijheden die je dient te kennen.
De verschillen en overeenkomsten tussen de rule of reason en de VWeu uitzonderingen
De beginselen van het Europees recht (loyale samenwerking, Unietrouw) en test ze aan de hand van de drietrapsraket:
1e fase Attributiebeginsel (art. 5, lid 2)
2e fase: Subsidiariteitsbeginsel
3e fase: Proportionaliteitsbeginsel
- De 6 functies van het recht in de unie
Het verband tussen rechtstreekse werking en voorrang
