Inleiding arbeidsrecht

Het arbeidsrecht is het geheel van rechtsregels dat betrekking heeft op de arbeidsverhouding van de onzelfstandige beroepsbevolking in de private en de publieke sector. In de private sector wordt dit commune arbeidsrecht genoemd en in de publieke sector ambtenarenrecht. Het arbeidsrecht is in grote mate gericht op de bescherming van de onzelfstandige beroepsbevolking tegen de risico’s van de industriële samenleving. Van belang is dat de vorm van organisatie van arbeidsverhoudingen bepaald wordt door de economische orde van een land in een bepaalde tijd.

  • Het arbeidsrecht is het geheel van rechtsregels dat betrekking heeft op de arbeidsverhouding van de onzelfstandige beroepsbevolking in de private en de publieke sector.

  • Het recht van de sociale zekerheid geldt voor alle Nederlandse burgers, dus niet alleen voor de onzelfstandige beroepsbevolking.

  • Tot de beroepsbevolking behoren:

    • Zelfstandigen

    • Onzelfstandige

    • Werklozen en gedeeltelijk arbeidsongeschikten

Wat houdt het arbeidsrecht in?

Het arbeidsrecht is het geheel van rechtsregels dat betrekking heeft op de arbeidsverhouding van de onzelfstandige beroepsbevolking in de private en de publieke sector. Dit begrip wordt dan in ruime zin gebruikt. In de private sector noemen we het ook wel het commune arbeidsrecht. In de publieke sector spreken we van het ambtenarenrecht. Als we het over het arbeidsrecht hebben, is de term sociaal recht ook van belang. Soms wordt deze term namelijk gebruikt als synoniem voor arbeidsrecht. In de meeste gevallen wordt de term ‘sociaal recht’ als een ruimer begrip gebruikt, dan omvat het niet alleen het arbeidsrecht in de private sector en het ambtenarenrecht, maar ook het pensioenrecht en het socialezekerheidsrecht. De regels hiervan gelden niet alleen voor de onzelfstandige beroepsbevolking, maar geldt voor alle ingezetenen in Nederland.

    • The topics and taxonomy of the study and working fields gives you insight in the amount of summaries that are tagged by authors on specific subjects. This type of navigation can help find summaries that you could have missed when just using the search tools. Tags are organised per field of study and per study institution. Note: not all content is tagged thoroughly, so when this approach doesn't give the results you were looking for, please check the search tool as back up
  3. Check or follow your (study) organizations:
    • by checking or using your study organizations you are likely to discover all relevant study materials.
    • this option is only available trough partner organizations
  4. Check or follow authors or other WorldSupporters
    • by following individual users, authors  you are likely to discover more relevant study materials.
  5. Use the Search tools
    • 'Quick & Easy'- not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject.
    • The search tool is also available at the bottom of most pages
