Casus:
Op 1 maart 2009 is de Wet bevordering voortgezet ouderschap en zorgvuldige scheiding in werking getreden. Dient de rechter, in verband daarmee, in beginsel steeds uit te gaan van een gelijke verdeling van de hoofdverblijfplaats van het kind en van een gelijke verdeling van de zorg- en opvoedingstaken tussen de ouders?
Hoge Raad:
Het antwoord op die vraag luidt ontkennend. De door de wetgever tot uitgangspunt genomen gelijkwaardigheid van de beide ouders en de wenselijkheid van een in beginsel gelijke verdeling van zorg- en opvoedingstaken na het uiteengaan van de ouders brengt niet mee dat, wanneer de ouders dienaangaande geen overeenstemming kunnen bereiken, de rechter bij zijn beslissing over de hoofdverblijfplaats van de minderjarige en de verdeling van de zorg- en opvoedingstaken het belang van de minderjarige niet het zwaarst zou mogen laten wegen. Dat belang dient immers bij de te verrichten afweging van belangen een overweging van de eerste orde te zijn.
De in de artikel 1:247 BW neergelegde gelijkwaardigheid van de ouders verplicht niet tot een gelijke (50-50%) verdeling van de tijd die het kind bij elke ouder doorbrengt.
