Artikelsamenvatting bij Europese Commissie Persbericht: ‘State aid: Commission refers Ireland to Court for failure to recover illegal tax benefits from Apple worth up to €13 billion’ van Brussel - 2017
Op 30 augustus 2016 had de Europese Commissie bepaald dat Ierland illegale staatssteun, die het via een belastingconstructie aan Apple gegeven had, terug moest vorderen. Het doel van deze terugvordering was rechtsherstel. Een haar later heeft Ierland echter nog niets van dit bedrag teruggekregen. De Commissie begrijpt dat dit een lastig proces is, maar desondanks moeten de lidstaten wel voldoende vooruitgang boeken om de eerlijke concurrentie op de markt te herstellen. Door de illegale staatssteun was deze eerlijke concurrentie verhinderd. Omdat het rechtsherstel nog steeds niet doorgevoerd is, blijft Apple van de illegale constructie profiteren. Omdat Ierland gepland heeft om pas in mei 2018 daadwerkelijk te beginnen met het terugvordern, heeft de Commissie Ierland voor het Hof van Justitie gedaagd. Ierland faalt namelijk in het implementeren van de beslissing van de Europese Commissie. Dit is in lijn met art. 108 lid 2 VWEU.
Ierland heeft hoger beroep aangetekend tegen de beslissing van de Commissie van augustus 2016. Dit beroep doet echter niet af aan de plicht om aan de beslissing uitvoering te geven (art. 278 VWEU). Daarom wordt het nu voor het HvJ gedaagd.
