Casus
Bromfietser wordt vervolgd wegens het niet dragen van een goedgekeurde helm. In een AMvB (het Reglement Verkeersregels en Verkeerstekens, RVV) is geregeld de verplichting voor bromfietsers om goedgekeurde helmen te dragen. Deze AMvB vindt zijn grondslag in een formele wet (de Wegenverkeerswet, WVW), met andere woorden: de WVW biedt de delegatiegrondslag voor het RVV. In de AMvB is verder bepaald dat bij ministerieel besluit wordt geregeld welke helmen goedkeuring krijgen. Zo`n ministerieel besluit is tot stand gebracht. Dit ministerieel besluit vindt weliswaar zijn grondslag in de AMvB, maar de vervolgde bromfietser bestrijdt dat de formele wet (WVW) subdelegatie toestaat.

Het ministerieel besluit is -gelet op de Toelichting op de AMvB- geen vorm van subdelegatie, maar uitvoering van de AMvB. Voor uitvoering van een AMvB door de minister is geen formeelwettelijke grondslag nodig.
