Omvang aansprakelijkheid; eigen schuld bij ouderen
Casus
Mevrouw Van Duiven, 67 jaar, wordt in het donker aangereden door Vrerink. De verzekeraar van Van Duiven, IZA, wil vervolgens de schade op Vrerink verhalen. Vrerink stelt dat Van Duiven zelf een risico heeft genomen door op een ongelukkig moment de weg op te gaan en dus eigen schuld heeft, en daarom hoogstens voor 20% aansprakelijk is. IZA stelt dat Vrerink zodanig onoplettend en onachtzaam gereden heeft dat zij de volledige schuld draagt.
Rechtsvraag
Wat is in casu de omvang van de aansprakelijkheid voor Vrerink?
Rechtsgang
De rechtbank en het Hof stellen Vrerink in het gelijk, en stellen haar slechts voor 20% aansprakelijk.
IZA gaat in cassatie en voert hierbij aan dat het Hof had moeten onderzoeken en moeten motiveren of de billijkheid wegens de uiteenlopende ernst van de over en weer gemaakte fouten en de andere omstandigheden van het geval een andere verdeling van de schade eist. Zoals bepaalt is in voorgaande arresten. Van Duiven behoort tot een kwetsbare groep wegens haar leeftijd en dat zij derhalve speciale bescherming dient te genieten.
De Hoge Raad overwoog dat de billijkheid moest uitmaken wat de verdeling van de aansprakelijkheid zou zijn. Zij stelt dat het niet mogelijk is om een dergelijke kwetsbare groep te onderscheiden, omdat het voor buitenstaanders onmogelijk is om te weten of iemand onder deze groep valt of niet. De Hoge Raad stelt dat er geen sprake was van een overmachtssituatie. De vaste causale verdeling dient volgens de Hoge Raad 50% te zijn. Indien de billijkheid een andere verdeling eist kan de aansprakelijkheid anders worden verdeeld.
