Casus
Yumak en Sadak waren kandidaten in de parlementaire verkiezingen van 3 november 2002 voor de Democratische Volkspartij DEHAP in de provincie Sirnak.
Turkije hanteerde tijdens die verkiezingen een (wettelijk vastgelegde) kiesdrempel van 10%. Dit resulteerde tot een non-represententatie in het parlement van 45% van de bevolking; 45% van de stemmers had gestemd op een partij die de kiesdrempel van 10% niet behaald had.
Yumak en Sadak deden een beroep op het recht op vrije verkiezingen bij de EHRM.
EHRM
Volgens het EHRM was er geen sprake van een schending van artikel 3 EVRM. Toch voerde ze aan dat het wenselijk kon zijn dat de kiesdrempel verlaagd zou worden om een optimale weergave van de verschillende politieke stromingen te verzekeren. Dit met het oog op de margin of appreciation: staten moeten zelf ruimte hebben om regels te rechtvaardigen ten aanzien van hun geschiedenis en cultuur.
