Onderwerp
Vrij verkeer van personen, artikel 18 EG, Richtlijn 90/364, verordening nummer 1612/68, zelfstandige rol van het burgerschap van de Unie
Casus
Chen bezit de Chinese nationaliteit. In mei 2000 is zij het grondgebied van het Verenigd Koninkrijk binnengekomen. Zij was toen zes maanden zwanger. In juli 200 reist Chen naar Ierland, Belfast, waar zij op 16 december bevalt van een dochter, Catherine.
Chen en Catherine wonen thans in Wales, Verengid Koninkrijk. Op grond van de Ierse wet, kan iedereen die in Ierland is geboren de Ierse nationaliteit verkrijgen. Ingevolge de Ierse wet is een in Ierland geboren persoon Iers onderdaan vanaf de geboorte als hij geen recht heeft op de nationaliteit van een ander land.
De Secretary of State for the Home Department heeft geweigerd om verzoeksters, Chen en Catherine, een vergunning voor langdurig verblijf te verlenen. Dit motiveerde zij met de overweging dat Catherine als kind van acht maanden geen uit het EG-Verdrag voortvloeiende rechten (zoals die voorzien in Regulation 5(1) van de EER Regulations) uitoefende en dat Chen (aan die Regulations) geen recht op verblijf in het VK had (ontleende).
In het geding was of Catherine, die minderjarige en burger van de Unie is, het recht had om in het VK te verblijven op grond van haar burgerschap van de Unie, en zo ja, of dit verblijfsrecht ook zou gelden voor haar Chinese moeder, als voornaamste verzorger van het kind.
Hof
Ja, Catherina had op grond van haar burgerschap van de Unie het recht om in het VK te verblijven. De voorwaarden voor een burger van de Unie om in een andere lidstaat te verblijven zijn: ziektenkostenverzekering; voldoende bestaansmiddelen (Dit had Catherina via Chen, haar vader).
Ja, wanneer artikel 18 EG en richtlijn 90/364 een recht om voor onbepaalde tijd te verblijven op het grondgebied van de ontvangende lidstaat verlenen aan de minderjarige van jonge leeftijd die onderdaan is van een andere lidstaat, moet deze zelfde bepaling de ouder die daadwerkelijk voor deze onderdaan zorgt, toestaan om met deze laatste in de lidstaat van ontvangst te verblijven.
