Feiten
I.c. was er sprake van een geding uit 1962 tussen Da Costa en Schaake N.V. en andere Nederlandse bedrijven tegen de Nederlandse Belastingdienst over het toepasselijke invoertarief. De douanerechten waren verhoogd door een gewijzigde rubricering. De bedrijven maakten hiertegen bezwaar bij de Belastingdienst. Zij werden niet in het gelijk gesteld en richtten zij zich tot de Tariefcommissie. De ondernemingen doen dan een beroep op het verbod van verhoging van douanerechten (art. 12 EEG, thans art. 30 VwEU).
In datzelfde jaar heeft de Tariefcommissie een viertal soortgelijke zaken bij het Hof aangemeld voor een prejudiciële beslissing. Dit bestond steeds uit vrijwel dezelfde prejudiciële vragen. Waaronder het arrest Van Gend en Loos. In deze zaak waarin verschillende geschillen zijn gevoegd, speelt een andere rechtsvraag.
Uit Van Gend en Loos blijkt dat art. 12 EEG-verdrag directe werking heeft en dat een verhoging van douanerechten door een gewijzigde rubricering in strijd is met het EG Verdrag. Het Hof moet dan oordelen of het deze nieuwe prejudiciële vraag in behandeling neemt terwijl het al in een soortgelijke zaak heeft beslist.
Hof van Justitie
Het Hof stelt dat zijn prejudiciële beslissingen de status van precedent krijgen. Dit wil zeggen dat deze oordelen dus erga omnes werken.
Volgens artikel 177 hebben nationale rechterlijke instanties (zoals de tariefcommissie), waarvan de beslissingen volgens het nationale recht niet vatbaar zijn voor hoger beroep, de plicht om zich met vragen van uitleg tot het Hof te wenden. Echter als het Hof al uitleg heeft gegeven dat kan deze plicht vervallen. Dat geldt ook als de opgeworpen vraag al in een soortgelijk geval in een prejudiciële zaak aan de orde is geweest.
Dit neemt niet weg dat iedere nationale rechter de bevoegdheid blijft ontlenen aan artikel 177 om (als hij dit nodig acht) de vragen opnieuw aan het Hof voor te leggen.
Kern
I.c. gaat het om de verduidelijking van 'acte éclairé'. Een nationale rechter hoeft geen prejudiciële vragen te stellen wanneer het Hof die vraag al in een eerdere procedure heeft beantwoord en dus al ‘verduidelijkt’ is.
