In deze zaak gaat het om een verzoek om een prejudiciële beslissing ingediend door de Court of Appeal (England and Wales, Verenigd Koninkrijk) in de procedure tussen International Transport Workers’ Federation, Finnish Seamen’s Union tegen Viking Line ABP, OÜ Viking Line Eesti.
Het Finse Viking verzorgt ferrydiensten tussen Tallin (Estland) en Helsinki (Finland). De matrozen van Viking waren aangesloten bij FSU, een dochtervakbond van ITF (the International Federation of Transport Workers' Union). ITF probeert met acties eigenaars van rederijen te verplichten om onder juiste vlaggen te handelen.
Viking vaarde onder een andere vlag dan de Finse en daarom reageerde ITF hierop met een boycotcampagne.
De vraag van de Engelse rechter aan het Hof is of een oproep van de internationale vakvereniging ITF aan haar nationale leden (tevens vakorganisaties) om niet te onderhandelen met een bepaalde onderneming, in strijd was met de vrijheid van vestiging zoals gewaarborgd door artikel 43 EG-Verdrag. De oproep kwam naar aanleiding van de vraag van de Finse vakbond van zeelieden, die zich op die manier het alleenrecht wenste voor te behouden om te onderhandelen met Viking, de Finse reder die dus overwoog uit te vlaggen naar Estland.
Artikel 43 EG moet zo worden uitgelegd dat een collectieve actie die een vakvereniging of een verbond van vakverenigingen voert tegen een particuliere onderneming om haar ertoe te brengen een collectieve overeenkomst aan te gaan met een zodanige inhoud, dat zij kan worden afgeschrikt gebruik te maken van de vrijheid van vestiging, in beginsel niet buiten de werkingssfeer van dit artikel valt.
Artikel 43 EG kent aan een particuliere onderneming rechten toe die zij kan inroepen tegen een vakvereniging of verbond van vakverenigingen.
Artikel 43 EG moet dus zo worden uitgelegd dat collectieve acties zoals in het hoofdgeding sprake van was, die een in een bepaalde lidstaat gevestigde particuliere onderneming ertoe moeten brengen om een collectieve arbeidsovereenkomst te sluiten met een in deze staat gevestigde vakvereniging en de bepalingen van deze overeenkomst toe te passen op de werknemers van een in een andere lidstaat gevestigde dochtermaatschappij van die onderneming, beperkingen in de zin van dit artikel zijn.
Deze beperkingen kunnen in principe worden gerechtvaardigd door een dwingende reden van algemeen belang, bijvoorbeeld de bescherming van werknemers, op voorwaarde dat wordt vastgesteld dat zij geschikt zijn om de verwezenlijking van het nagestreefde legitieme doel te verzekeren en niet verder gaan dan noodzakelijk is om dit doel te bereiken.
Conclusie: vakbondsacties gericht tegen het plan tot omvlagging van een schip van Finland naar Estland werden i.c. getoetst aan de EG-bepalingen inzake vrijheid van vestiging. Het Hof legt artikel 43 EG uit en schoof de beslissing over het gerechtvaardigd karakter van de “belemmering van de vrijheid van vestiging” uiteindelijk door naar de nationale rechter.
