Casus
Een zoon (gedaagde) heeft zijn bejaarde moeder (inmiddels overleden; erflaatster) bijgestaan met de financiën. In een dergelijke situatie is er geen sprake van beheer en geen verplichting tot het afleggen van rekening en verantwoording aan eisers als mede-erfgenamen, in die zin dat gedaagde alle uitgaven tegenover hen dient te verantwoorden. Wel moet hij uitleg kunnen geven over door hem verrichte handelingen die niet binnen het normale uitgavenpatroon vallen.
Rechtbank
Gedaagde heeft geen afdoende verklaring kunnen geven voor door hem met de pinpas van erflaatster gedane hoge geldopnames. Door de onrechtmatige opnames geleden schade dient aan de boedel te worden vergoed. De gevorderde verklaring voor recht dat gedaagde zijn aandeel in de onttrokken goederen ingevolge artikel 3:194 lid 2 BW heeft verbeurd, is toewijsbaar.
