Feitelijk leiding geven en dubbele strafbaarheid (HR 18 oktober 1988, NJ 1989, 496)
Weliswaar vereist artikel 5 lid 1, onder 2e Sr dat op de aan de verdachte verweten gedraging door de wet van het land waarop die werd begaan straf is gesteld, maar stelt niet als eis dat die gedraging door die wet op dezelfde wijze als naar Nederlands recht strafbaar is gesteld (hier: als feitelijk leiding geven aan een feit begaan door een rechtspersoon).
Indien vaststaat dat een rechtspersoon als bedoeld in artikel 51 Sr een strafbaar feit heeft begaan, behoeft ten aanzien van hen, die ervan worden verdacht tot dat feit opdracht of aan dat feit leiding te hebben gegeven, slechts te worden gesteld, onderzocht en bewezen dat zij inderdaad zodanige opdracht of leiding hebben gegeven, zonder dat er noodzaak is tot een onderzoek naar de vraag waar zij daartoe bepaalde handelingen hebben verricht en – die buiten Nederland hebben plaatsgevonden – of daarop straf is gesteld door de wet van het betrokken land.
