Wat zijn de feiten van de casus?
Het Kroatische stel M en V trouwde in 2002 en kregen in 2003 een kind. M dient in 2004 een verzoek tot echtscheiding in bij de rechtbank. V stemt in met de echtscheiding, maar maakt wel bezwaar tegen de omgangsregeling die M heeft voorgesteld en de kinderalimentatie. De rechtbank weigert de echtscheiding uit te spreken en deze beslissing wordt aangehouden in afwachting van verschillende zittingen. Hierna dient M tweemaal de klacht in over de duur van de procedure, aangezien hij hierdoor niet opnieuw kan trouwen. In 2009 wordt aan M een schadevergoeding toegewezen vanwege de lange duur van de procedure. De echtscheiding wordt echter nog steeds niet uitgesproken. In 2010 wordt de echtscheiding uitgesproken, aangezien de partijen overeenstemming hebben bereikt over de omgangsregeling en de kinderalimentatie. M trouwt in datzelfde jaar opnieuw en verzoekt het EHRM te oordelen dat de echtscheidingsprocedure onredelijk lang heeft geduurd en dit in strijd is met artikel 6 EVRM.
Hoe beoordeelt het Hof het verzoek?
Het EHRM oordeelt dat er inderdaad een inbreuk was op artikel 6 EVRM en acht hierbij de volgende aspecten relevant:
1. De complexiteit van de zaak
2. De houding van de relevante autoriteiten en van de verzoeker
3. Het belang van de verzoeker.
De echtscheiding heeft vijfenhalf jaar geduurd en dat was niet aan M te verwijten. Daarnaast was het recht van M om opnieuw te huwen beperkt doordat hij niet kon scheiden. Hij is katholiek en daarom was het voor hem zeer van belang opnieuw te kunnen trouwen met zijn nieuwe partner.
